국민기초생활 보장법 시행령 제38조의2(이의신청의 방법 등)

① 법 제40조에 따라 이의신청을 하려는 사람은 다음 각 호의 사항을 적은 이의신청서를 직접 또는 담당 공무원의 협조를 받아 작성하여 증명서류를 첨부하여 시ㆍ도지사에게 제출하여야 한다.

② 이의신청을 하려는 사람이 법 제7조제1항제1호부터 제4호까지 및 제7호의 급여 중 둘 이상의 급여를 신청하거나 받는 사람에 해당하는 경우에는 법 제7조에 따른 급여 종류별 선정기준이 가장 낮은 급여를 소관하는 중앙행정기관의 장에게 신청하여야 한다. 이 경우 이의신청을 받은 중앙행정기관의 장은 관련 급여를 소관하는 중앙행정기관의 장의 의견을 들을 수 있다.
