국적법 시행령 제12조(외국 국적 포기사실증명의 요구)

① 법무부장관은 법 제10조제1항에 규정된 사람(제11조제1항 또는 제3항에 따라 국적포기증명서등을 제출하거나 외국국적불행사 서약서를 제출한 사람은 제외한다)에 대하여 그 기간이 지난 후에 그 외국 국적을 포기하였는지를 확인할 필요가 있으면 그 포기사실을 증명할 것을 요구할 수 있다.

② 제1항에 규정된 사람의 소재를 알 수 없거나 그 밖에 서면으로 요구할 수 없는 부득이한 사정이 있을 때에는 관보에 게재하는 방식으로 제1항의 요구를 할 수 있다. 이 경우 관보에 게재된 날의 다음 날에 그 요구의 의사표시가 도달된 것으로 본다.

③ 제1항 또는 제2항에 따라 요구를 받은 사람은 요구를 받은 때부터 1개월 내에 그 외국의 영사나 그 밖의 관련 공무원이 발급한 국적포기증명서등으로 그 외국 국적을 포기한 사실을 증명하여야 하며, 이를 이행하지 아니한 경우에는 그 외국 국적을 포기하지 않은 것으로 본다.

④ 제3항에 규정된 사람으로서 천재지변이나 그 밖의 불가항력적 사유로 그 기간 내에 요구사항을 이행하지 못한 사람은 그 사유가 소멸된 때부터 10일 내에 그 외국 국적을 포기한 사실을 증명할 수 있다.
