Enforcement Decree of the National Land Planning and Utilization Act, Article 6 (Restrictions on Changes to Use Zones under Other Acts)

①법 제9조 각 호 외의 부분 본문에 따라 중앙행정기관의 장 또는 지방자치단체의 장은 용도지역ㆍ용도지구ㆍ용도구역의 지정 또는 변경에 대한 도시ㆍ군관리계획의 결정을 의제하는 계획을 허가ㆍ인가ㆍ승인 또는 결정하고자 하는 경우에는 미리 다음 각 호의 구분에 따라 법 제106조에 따른 중앙도시계획위원회(이하 "중앙도시계획위원회"라 한다) 또는 법 제113조에 따른 지방도시계획위원회(이하 "지방도시계획위원회"라 한다)의 심의를 받아야 한다. 다만, 법 제8조제4항제1호에 해당하거나 도시ㆍ군관리계획의 결정을 의제하는 계획에서 그 계획면적의 5퍼센트 미만을 변경하는 경우에는 그러하지 아니하다. <개정 2004.1.20, 2012.4.10, 2014.1.14>

②중앙행정기관의 장 또는 지방자치단체의 장이 제1항의 규정에 의하여 중앙도시계획위원회 또는 지방도시계획위원회의 심의를 받는 때에는 다음 각호의 서류를 국토교통부장관 또는 당해 지방도시계획위원회가 설치된 지방자치단체의 장에게 제출하여야 한다. <개정 2008.2.29, 2013.3.23>
