국토의 계획 및 이용에 관한 법률 시행령 제75조(방재지구안에서의 건축제한)

방재지구안에서는 풍수해ㆍ산사태ㆍ지반붕괴ㆍ지진 그 밖에 재해예방에 장애가 된다고 인정하여 도시ㆍ군계획조례가 정하는 건축물을 건축할 수 없다. 다만, 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장 또는 군수가 지구의 지정목적에 위배되지 아니하는 범위안에서 도시ㆍ군계획조례가 정하는 기준에 적합하다고 인정하여 당해 지방자치단체에 설치된 도시계획위원회의 심의를 거친 경우에는 그러하지 아니하다. <개정 2012.4.10>
