농지법 시행령 제60조의2(농지에서의 구역 등의 지정ㆍ결정에 관한 협의 절차 등)
Enforcement Decree of the Farmland Act, Article 60-2 (Procedures for Consultation on Designation or Decision of Zones, etc. on Farmland)
① 관계 행정기관의 장이 법 제43조의2제1항에 따라 농지를 특정 용도로 이용하기 위하여 농림축산식품부장관(제71조제1항제2호의3에 따라 권한을 위임받은 자를 포함한다. 이하 이 조 및 별표 2의2에서 같다)과 미리 협의해야 하는 지역ㆍ지구 및 구역 등(이하 이 조 및 별표 2의2에서 "지역등"이라 한다)의 범위는 별표 2의2와 같다.
(1) The scope of areas, districts and zones, etc. (hereinafter referred to as "areas, etc." in this Article and Table 2-2) on which the head of a relevant administrative agency must consult in advance with the Minister of Agriculture, Food and Rural Affairs (including a person delegated authority under Article 71 (1) 2-3; the same applies hereinafter in this Article and Table 2-2) in order to use farmland for a specific purpose under Article 43-2 (1) of the Act is as set forth in Table 2-2.
② 관계 행정기관의 장은 법 제43조의2제1항에 따라 농지를 특정 용도로 이용하기 위하여 지역등으로 지정 또는 결정하거나 변경(제3항에 따른 경미한 변경사항은 제외한다. 이하 이 조에서 같다)하려는 경우에는 농림축산식품부령으로 정하는 협의요청서에 협의에 필요한 서류를 첨부하여 농림축산식품부장관에게 제출해야 한다. 이 경우 협의에 필요한 서류는 다음 각 호의 구분에 따른 농지의 종류 및 면적에 따라 농림축산식품부령으로 정한다.
(2) When intending to designate, decide or change (excluding minor changes under paragraph (3); the same applies hereinafter in this Article) areas, etc. in order to use farmland for a specific purpose under Article 43-2 (1) of the Act, the head of a relevant administrative agency shall submit to the Minister of Agriculture, Food and Rural Affairs a request for consultation prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs, with the documents necessary for consultation attached. In such cases, the documents necessary for consultation shall be prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs according to the type and area of farmland under the following classification:
1. 법 제34조제2항제1호에 해당하는 농지인 경우
1. Farmland falling under Article 34 (2) 1 of the Act:
가. 지정ㆍ결정 또는 변경하려는 지역등에 농업진흥지역 안의 농지가 포함되는 경우로서 해당 농지가 포함된 농업진흥지역의 면적이 1만제곱미터를 초과하는 경우
(a) Where the areas, etc. to be designated, decided or changed include farmland in an agricultural promotion area, and the area of the agricultural promotion area that includes the farmland exceeds 10,000 square meters;
나. 지정ㆍ결정 또는 변경하려는 지역등에 농업진흥지역 안의 농지가 포함되는 경우로서 해당 농지가 포함된 농업진흥지역의 면적이 1만제곱미터 이하인 경우
(b) Where the areas, etc. to be designated, decided or changed include farmland in an agricultural promotion area, and the area of the agricultural promotion area that includes the farmland is 10,000 square meters or less;
다. 지정ㆍ결정 또는 변경하려는 지역등에 포함된 농지가 농업진흥지역 밖의 농지인 경우
(c) Where the farmland included in the areas, etc. to be designated, decided or changed is farmland outside an agricultural promotion area;
2. 제1호 외의 농지인 경우
2. Farmland other than that under subparagraph 1.
③ 법 제43조의2제1항 후단에서 "대통령령으로 정하는 경미한 사항"이란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
(3) The "minor matters prescribed by Presidential Decree" in the latter part of Article 43-2 (1) of the Act means any of the following cases:
1. 해당 지역등 안에 포함된 농지의 면적이 「공간정보의 구축 및 관리 등에 관한 법률」 제79조에 따른 토지 분할을 위한 측량 결과에 따라 증감되는 경우
1. Where the area of farmland included in the areas, etc. increases or decreases as a result of a survey for land division under Article 79 of the Act on the Establishment, Management, etc. of Spatial Data;
2. 해당 지역등 안에 포함된 농지의 면적이 감소하는 경우
2. Where the area of farmland included in the areas, etc. decreases;
3. 1만제곱미터 미만의 농지(농업진흥지역 밖의 농지로 한정한다)가 해당 지역등에 추가로 포함되는 경우
3. Where farmland of less than 10,000 square meters (limited to farmland outside an agricultural promotion area) is additionally included in the areas, etc.;
4. 지역등의 지정 또는 결정에 관하여 규정한 해당 법률에서 관계 행정기관의 장과 협의 없이 변경할 수 있도록 규정한 사항을 변경하는 경우
4. Where matters that the statute prescribing the designation or decision of the areas, etc. allows to be changed without consultation with the head of the relevant administrative agency are changed.
④ 농림축산식품부장관은 법 제43조의2제1항에 따라 관계 행정기관의 장으로부터 지역등의 지정ㆍ결정 또는 변경에 관한 협의를 요청받은 경우에는 다음 각 호의 기준에 따라 검토해야 한다.
(4) When requested by the head of a relevant administrative agency to consult on the designation, decision or change of areas, etc. under Article 43-2 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs shall review it according to the following criteria:
1. 농업진흥지역은 가능한 한 지역등에 포함되지 않도록 하되, 불가피하게 포함되는 경우에는 지역등의 지정ㆍ결정 또는 변경 목적에 필요한 범위에서 최소한의 면적으로 포함할 것
1. Agricultural promotion areas shall not be included in the areas, etc. as far as possible, and where unavoidably included, shall be included in the minimum area necessary for the purpose of designating, deciding or changing the areas, etc.;
2. 지역등의 지정ㆍ결정 또는 변경에 농지의 전용이 수반되는 경우에는 법 제37조제2항 각 호의 제한 사유에 해당하는지 여부를 고려할 것. 다만, 지역등의 지정ㆍ결정 또는 변경 단계에서 법 제37조제2항 각 호의 제한 사유에 해당하는지 여부를 판단하기 어려운 경우에는 법 제34조제1항에 따른 농지전용허가(다른 법률에 따라 농지전용허가가 의제되는 협의를 포함한다) 시 사후심사할 것을 조건으로 협의할 수 있다.
2. Where designating, deciding or changing the areas, etc. entails farmland conversion, whether the grounds for restriction under the subparagraphs of Article 37 (2) of the Act apply shall be considered: Provided, That where it is difficult to determine whether the grounds for restriction under the subparagraphs of Article 37 (2) of the Act apply at the stage of designating, deciding or changing the areas, etc., consultation may be held on the condition of post-review at the time of permission for farmland conversion under Article 34 (1) of the Act (including consultation deemed to include permission for farmland conversion under other statutes);
3. 지역등의 지정ㆍ결정 또는 변경에 농지의 전용이 수반되는 경우에는 해당 농지의 전용에 관하여 제33조제1항 각 호의 심사기준에 부합할 것. 다만, 지역등의 지정ㆍ결정 또는 변경 단계에서 제33조제1항 각 호의 심사기준에 부합하는지 여부를 판단하기 어려운 경우에는 법 제34조제1항에 따른 농지전용허가(다른 법률에 따라 농지전용허가가 의제되는 협의를 포함한다) 시 사후심사할 것을 조건으로 협의할 수 있다.
3. Where designating, deciding or changing the areas, etc. entails farmland conversion, the conversion of that farmland shall conform to the review criteria in the subparagraphs of Article 33 (1): Provided, That where it is difficult to determine whether the review criteria in the subparagraphs of Article 33 (1) are met at the stage of designating, deciding or changing the areas, etc., consultation may be held on the condition of post-review at the time of permission for farmland conversion under Article 34 (1) of the Act (including consultation deemed to include permission for farmland conversion under other statutes);
4. 농지가 원형보전되는 경우에는 농업경영환경에 지장이 없도록 피해방지계획 등 대책이 수립되어 있을 것
4. Where farmland is preserved in its original form, measures such as a damage prevention plan shall be established so as not to impede the farming environment;
5. 지정ㆍ결정 또는 변경하려는 지역등이 법 제47조에 따른 농지의 관리에 관한 기본방침 및 법 제48조제1항ㆍ제2항에 따른 농지의 관리에 관한 기본계획ㆍ세부 실천계획에 부합할 것
5. The areas, etc. to be designated, decided or changed shall conform to the basic policies on farmland management under Article 47 of the Act and the basic plans and action plans on farmland management under Article 48 (1) and (2) of the Act.
⑤ 농림축산식품부장관은 법 제43조의2제1항에 따른 협의를 위하여 필요한 경우에는 관계 시ㆍ도지사, 시장ㆍ군수 또는 자치구구청장, 「농어촌정비법」 제17조에 따른 농업생산기반시설관리자 및 한국농어촌공사의 의견을 들을 수 있다.
(5) Where necessary for consultation under Article 43-2 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs may hear the opinions of the relevant Mayor/Do Governor, the head of a Si/Gun or autonomous Gu, the manager of agricultural production infrastructure facilities under Article 17 of the Rural Maintenance Act, and the Korea Rural Community Corporation.
⑥ 제5항에 따라 농림축산식품부장관으로부터 의견제출의 요청을 받은 자는 정당한 사유가 있는 경우를 제외하고는 요청을 받은 날부터 30일 이내에 농림축산식품부장관에게 의견을 제출해야 한다.
(6) A person requested to submit an opinion by the Minister of Agriculture, Food and Rural Affairs under paragraph (5) shall submit the opinion to the Minister within 30 days from the date of the request, except where there are justifiable grounds.
