Enforcement Decree of the Act on the Improvement of Urban Areas and Residential Environments, Article 70 (Supply of Shared-Equity Housing)

① 법 제80조에 따른 지분형주택(이하 "지분형주택"이라 한다)의 규모, 공동 소유기간 및 분양대상자는 다음 각 호와 같다.

1. 지분형주택의 규모는 주거전용면적 60제곱미터 이하인 주택으로 한정한다.

2. 지분형주택의 공동 소유기간은 법 제86조제2항에 따라 소유권을 취득한 날부터 10년의 범위에서 사업시행자가 정하는 기간으로 한다.

3. 지분형주택의 분양대상자는 다음 각 목의 요건을 모두 충족하는 자로 한다.

나. 세대주로서 제13조제1항에 따른 정비계획의 공람 공고일 당시 해당 정비구역에 2년 이상 실제 거주한 사람

다. 정비사업의 시행으로 철거되는 주택 외 다른 주택을 소유하지 아니한 사람

② 지분형주택의 공급방법ㆍ절차, 지분 취득비율, 지분 사용료 및 지분 취득가격 등에 관하여 필요한 사항은 사업시행자가 따로 정한다.
