도시 및 주거환경정비법 시행령 제80조(국ㆍ공유지의 무상양여 등)

① 법 제101조제1항에 따라 국가 또는 지방자치단체로부터 토지를 무상으로 양여받은 사업시행자는 사업시행계획인가 고시문 사본을 그 토지의 관리청 또는 지방자치단체의 장에게 제출하여 그 토지에 대한 소유권이전등기절차의 이행을 요청하여야 한다. 이 경우 토지의 관리청 또는 지방자치단체의 장은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 그 토지의 토지대장 등본 또는 등기사항증명서를 확인하여야 한다.

② 법 제101조제1항제2호에서 "대통령령으로 정하는 재개발구역"이란 제79조제2항의 지역을 대상으로 한 재개발구역을 말한다.

③ 제1항에 따른 요청을 받은 관리청 또는 지방자치단체의 장은 즉시 소유권이전등기에 필요한 서류를 사업시행자에게 교부하여야 한다.

④ 사업시행자는 법 제113조에 따라 사업시행계획인가가 취소된 때에는 법 제101조제1항에 따라 무상양여된 토지를 원소유자인 국가 또는 지방자치단체에 반환하기 위하여 필요한 조치를 하고, 즉시 관할 등기소에 소유권이전등기를 신청하여야 한다.
