민사집행법 제101조(일괄매각절차)

①제98조 및 제99조의 일괄매각결정에 따른 매각절차는 이 관의 규정에 따라 행한다. 다만, 부동산 외의 재산의 압류는 그 재산의 종류에 따라 해당되는 규정에서 정하는 방법으로 행하고, 그 중에서 집행관의 압류에 따르는 재산의 압류는 집행법원이 집행관에게 이를 압류하도록 명하는 방법으로 행한다.

②제1항의 매각절차에서 각 재산의 대금액을 특정할 필요가 있는 경우에는 각 재산에 대한 최저매각가격의 비율을 정하여야 하며, 각 재산의 대금액은 총대금액을 각 재산의 최저매각가격비율에 따라 나눈 금액으로 한다. 각 재산이 부담할 집행비용액을 특정할 필요가 있는 경우에도 또한 같다.

③여러 개의 재산을 일괄매각하는 경우에 그 가운데 일부의 매각대금으로 모든 채권자의 채권액과 강제집행비용을 변제하기에 충분하면 다른 재산의 매각을 허가하지 아니한다. 다만, 토지와 그 위의 건물을 일괄매각하는 경우나 재산을 분리하여 매각하면 그 경제적 효용이 현저하게 떨어지는 경우 또는 채무자의 동의가 있는 경우에는 그러하지 아니하다.

④제3항 본문의 경우에 채무자는 그 재산 가운데 매각할 것을 지정할 수 있다.
