병역법 시행령 제147조의2(국외여행허가의 취소)

Enforcement Decree of the Military Service Act, Article 147-2 (Cancellation of Permission for Overseas Travel)

① 법 제70조제7항에 따라 국외여행허가 또는 국외여행기간 연장허가를 취소하고 병역의무를 부과할 수 있는 경우는 다음 각 호와 같다. 다만, 제1호다목 및 마목의 경우 해당 목에 해당하는 사람이 제128조제5항의 재외국민 2세인 기간 동안에 있는 경우는 제외한다. <개정 2010.7.21, 2010.10.1, 2012.12.20, 2013.12.4, 2014.11.4, 2016.6.14, 2016.11.29, 2018.5.28, 2019.7.2, 2020.6.30, 2021.10.14>

1. 국외이주 목적으로 국외여행허가를 받고 출국하거나 국외이주사유로 국외여행기간 연장허가를 받은 사람이 다음 각 목의 어느 하나에 해당하는 경우. 이 경우 부 또는 모와 거주하는 것을 요건으로 국외여행허가 또는 국외여행기간 연장허가를 받은 사람은 부 또는 모가 가목부터 다목까지의 사유에 해당하는 경우에도 적용한다.

다. 1년의 기간 내에 통틀어 6개월 이상 국내에서 체재하고 있는 경우. 이 경우 국내체재기간(입국일은 포함하고 출국일은 제외한다. 이하 같다)은 산정일부터 거꾸로 계산하여 합산하되, 1) 또는 2)의 사유로 국내에서 60일 이내의 기간 동안 체재하는 경우와 부ㆍ모나 배우자가 국내에 체재하지 아니한 상태에서 3) 또는 4)의 사유로 국내에 체재하는 경우에는 그 기간을 합산하지 아니한다.

② 병무청장은 제1항에도 불구하고 제1항제1호다목 및 마목에 해당되는 사람에 대해서는 한 번만 3개월의 허가취소 유예기간을 주고, 그 기간 내에 출국하지 아니하는 경우에는 국외여행허가나 국외여행기간 연장허가를 취소하고 병역의무를 부과할 수 있다. <개정 2018.5.28>
