병역법 제20조의2(임기제부사관제의 운영)

① 병무청장이나 각 군 참모총장은 우수한 숙련인력을 확보하기 위하여 필요하다고 인정하는 경우에는 본인의 지원에 의하여 현역병의 복무를 마친 후 4년의 범위에서 정하여진 기간을 임기로 하는 부사관(이하 "임기제부사관"이라 한다)으로 복무할 사람을 선발할 수 있다. <개정 2020.12.22>

② 임기제부사관으로 복무할 사람은 다음 각 호의 어느 하나에 해당하는 사람 중에서 선발한다. <개정 2016.5.29, 2020.12.22>

③ 임기제부사관에게는 대통령령으로 정하는 바에 따라 보수를 지급한다. <개정 2020.12.22>

④ 제2항제1호에 따라 임기제부사관으로 선발된 사람의 입영에 관하여는 제20조제2항을 준용한다. <개정 2020.12.22>

⑤ 각 군 참모총장은 임기제부사관이 복무의 중단을 원하는 경우에는 질병ㆍ심신장애 등 대통령령으로 정하는 사유로 현역 복무에 적합하지 아니하다고 인정되는 경우에만 허가할 수 있다. <개정 2020.12.22>
