산업재해보상보험법 시행령 제2조의2(상시근로자 수의 산정 및 적용 시점)

① 제2조제1항제6호에 따른 상시근로자 수는 사업을 시작한 후 최초로 근로자를 사용한 날부터 그 사업의 가동일수(稼動日數) 14일 동안 사용한 근로자 연인원(延人員)을 14로 나누어 산정한다. 이 경우 상시근로자 수가 5명 미만이면 최초로 근로자를 사용한 날부터 하루씩 순차적으로 미루어 가동기간 14일 동안 사용한 근로자 연인원을 14로 나누어 산정한다. <개정 2017.12.26>

② 제1항에도 불구하고 최초로 근로자를 사용한 날부터 14일 이내에 사업이 종료되거나 업무상 재해가 발생한 경우에는 그 때까지 사용한 연인원을 그 가동일수로 나누어 산정한다.

③ 제1항 및 제2항에 따라 산정한 상시근로자 수가 5명 이상이 되는 사업은 상시근로자 수가 최초로 5명 이상이 되는 해당 기간의 첫 날에 상시근로자 수가 5명 이상이 되는 사업이 성립한 것으로 본다. <개정 2017.12.26>
