산업재해보상보험법 시행령 제74조(유족특별급여의 지급기준 등)

① 법 제79조제1항에서 "대통령령으로 정하는 유족특별급여"란 평균임금의 30일분에서 사망자 본인의 생활비(평균임금의 30일분에 별표 10에 따른 사망자 본인의 생활비 비율을 곱하여 산정한 금액을 말한다)를 뺀 후 별표 11에 따른 취업가능개월수에 대응하는 라이프니츠 계수를 곱하여 산정한 금액에서 법 제62조에 따른 유족보상일시금을 뺀 금액을 말한다.

② 제1항의 취업가능개월수의 산정에 관하여는 제73조제3항을 준용한다. 이 경우 "장해등급이 판정된 날"은 "사망한 날"로 본다. <개정 2021.6.8>
