산업재해보상보험법 시행령 제77조의2(보험급여수급계좌)
Enforcement Decree of the Industrial Accident Compensation Insurance Act, Article 77-2 (Insurance Benefit Accounts)
① 법 제82조제2항 단서에서 "정보통신장애나 그 밖에 대통령령으로 정하는 불가피한 사유"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
(1) "An information and communications failure or any other unavoidable reason prescribed by Presidential Decree" in the proviso to Article 82 (2) of the Act means any of the following cases:
1. 법 제82조제2항 본문에 따른 보험급여수급계좌(이하 "보험급여수급계좌"라 한다)가 개설된 금융기관이 폐업, 업무정지, 정보통신장애 등으로 정상영업이 불가능하여 보험급여를 보험급여수급계좌로 이체할 수 없는 경우
1. Where insurance benefits cannot be transferred to the insurance benefit account under the main text of Article 82 (2) of the Act (hereinafter referred to as an "insurance benefit account") because the financial institution where the account was opened cannot operate normally due to closure, suspension of business, an information and communications failure, or the like;
2. 그 밖에 고용노동부장관이 보험급여를 보험급여 지급 결정일부터 14일 이내에 보험급여수급계좌로 이체하는 것이 불가능하다고 인정하는 경우
2. Any other case where the Minister of Employment and Labor recognizes that it is impossible to transfer insurance benefits to the insurance benefit account within 14 days from the date of the decision to pay them.
② 공단은 법 제82조제2항 단서에 따라 보험급여를 보험급여수급계좌로 이체할 수 없을 때에는 수급권자에게 해당 보험급여를 직접 현금으로 지급할 수 있다.
(2) If the Service cannot transfer insurance benefits to an insurance benefit account under the proviso to Article 82 (2) of the Act, it may pay the insurance benefits directly to the beneficiary in cash.
③ 공단은 수급권자가 법 제82조제2항 본문에 따른 신청을 하면 보험급여를 보험급여수급계좌로 받을 수 있다는 사실을 수급권자에게 안내해야 한다.
(3) The Service shall inform beneficiaries that they can receive insurance benefits through an insurance benefit account if they apply under the main text of Article 82 (2) of the Act.
