식품위생법 시행령 제6조(소비자 등의 위생검사등 요청)

① 법 제16조제1항 각 호 외의 부분 본문에서 "대통령령으로 정하는 그 소속 기관의 장"이란 지방식품의약품안전청장을 말하고, "대통령령으로 정하는 일정 수 이상의 소비자"란 같은 영업소에 의하여 같은 피해를 입은 5명 이상의 소비자를 말한다. <개정 2014.1.28>

② 법 제16조제1항에 따라 법 제22조에 따른 출입ㆍ검사ㆍ수거 등(이하 이 조에서 "위생검사등"이라 한다)을 요청하려는 자는 총리령으로 정하는 요청서를 식품의약품안전처장(지방식품의약품안전청장을 포함한다. 이하 이 조에서 같다), 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사(이하 "시ㆍ도지사"라 한다) 또는 시장ㆍ군수ㆍ구청장(자치구의 구청장을 말한다. 이하 같다)에게 제출하되, 소비자의 대표자, 「소비자기본법」 제29조에 따른 소비자단체의 장 또는 「식품ㆍ의약품분야 시험ㆍ검사 등에 관한 법률」 제6조에 따른 시험ㆍ검사기관의 장을 통하여 제출하여야 한다. <개정 2010.3.15, 2013.3.23, 2014.1.28, 2014.7.28, 2016.7.26>

③ 식품의약품안전처장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 법 제16조제2항에 따라 위생검사등의 결과를 알리는 경우에는 소비자의 대표자, 소비자단체의 장 또는 시험ㆍ검사기관의 장이 요청하는 방법으로 하되, 따로 정하지 아니한 경우에는 문서로 한다. <개정 2013.3.23, 2014.1.28, 2014.7.28>
