아동학대범죄의 처벌 등에 관한 특례법 제11조의2(조사)

① 아동학대전담공무원은 피해아동의 보호 및 사례관리를 위한 조사를 할 수 있다. 이 경우 아동학대전담공무원은 아동학대행위자 및 관계인에 대하여 출석ㆍ진술 및 자료제출을 요구할 수 있으며, 아동학대행위자 및 관계인은 정당한 사유가 없으면 이에 따라야 한다. <개정 2021.1.26>

② 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 「유아교육법」 및 「초ㆍ중등교육법」에 따른 교원의 교육활동 중 행위가 아동학대범죄로 신고되어 조사 중인 사건과 관련하여 관할 교육감이 의견을 제출하는 경우 이를 「아동복지법」 제22조제3항제3호에 따른 아동학대사례의 판단에 참고하여야 한다. <신설 2023.12.26, 2026.2.3>
