아동학대범죄의 처벌 등에 관한 특례법 제57조(항고와 재항고)

① 제47조에 따른 피해아동보호명령(제51조에 따른 연장의 결정을 포함한다) 및 제50조에 따른 그 취소 또는 종류의 변경, 제52조에 따른 임시보호명령 및 그 취소 또는 종류의 변경에 있어서 그 결정에 영향을 미칠 법령 위반이 있거나 중대한 사실오인이 있는 때 또는 그 결정이 현저히 부당한 때에는 피해아동, 아동학대행위자, 법정대리인, 검사, 변호사, 시ㆍ도지사, 시장ㆍ군수ㆍ구청장 또는 보조인은 가정법원본원합의부에 항고할 수 있다. 다만, 가정법원이 설치되지 아니한 지역에서는 지방법원본원합의부에 하여야 한다. <개정 2020.3.24, 2024.12.20>

② 판사가 피해아동보호명령의 청구를 기각한 경우 피해아동, 그 법정대리인, 검사, 변호사, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 항고할 수 있다. 이 경우 항고법원에 관하여는 제1항을 준용한다. <개정 2020.3.24, 2024.12.20>

③ 아동보호전문기관의 장은 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 제1항 및 제2항에 따른 항고를 요청할 수 있다. <신설 2020.3.24>

④ 제1항 및 제2항에 따른 피해아동보호명령 등의 항고 및 재항고에 관하여는 「가정폭력범죄의 처벌 등에 관한 특례법」 제49조제3항 및 제50조부터 제53조까지의 규정을 준용한다. <개정 2020.3.24>
