의료급여법 시행령 제16조의3(과징금 미납자에 대한 처분)

① 보건복지부장관은 법 제29조제1항에 따른 과징금을 내야 할 자가 납부기한까지 과징금을 내지 아니하면 같은 조 제2항에 따라 납부기한이 지난 후 15일 이내에 독촉장을 발급하여야 한다. 이 경우 납부기한은 독촉장을 발급하는 날부터 10일 이내로 하여야 한다.

② 보건복지부장관은 과징금을 내야 하는 자가 제1항에 따른 독촉장을 받고도 그 납부기한까지 과징금을 내지 아니하면 법 제33조제1항 및 이 영 제19조제1호에 따라 과징금 징수에 관한 권한을 위임받은 시ㆍ도지사의 요청을 받아 과징금 부과처분을 취소하고 법 제28조제1항에 따른 업무정지처분을 하거나 국세 체납처분 또는 지방세 체납처분(법 제33조제1항 및 이 영 제19조제1호에 따라 과징금 징수에 관한 권한이 시ㆍ도지사에게 위임된 경우만 해당한다)의 예에 따라 징수하여야 한다.

③ 제2항에 따라 과징금 부과처분을 취소하고 업무정지처분을 하려면 처분대상자에게 서면으로 그 내용을 통지하여야 한다. 이 경우 그 서면에는 처분의 변경사유와 업무정지처분의 기간 등 업무정지처분에 필요한 사항이 포함되어야 한다.
