자본시장과 금융투자업에 관한 법률 제442조의2(위반행위로 얻은 이익의 산정)

제429조의2 및 제429조의3에 따른 위반행위와 관련된 거래로 얻은 이익 또는 이로 인하여 회피한 손실액 및 제443조에 따른 위반행위로 얻은 이익 또는 회피한 손실액은 그 위반행위를 통하여 이루어진 거래로 발생한 총수입에서 그 거래를 위한 총비용을 공제한 차액을 말한다. 이 경우 각 위반행위의 유형별 구체적인 산정방식은 대통령령으로 정한다.
