자본시장과 금융투자업에 관한 법률 제93조(파생상품의 운용 특례)

① 집합투자업자는 파생상품 매매에 따른 위험평가액(제81조제1항제1호마목의 위험평가액을 말한다. 이하 이 조에서 같다)이 대통령령으로 정하는 기준을 초과하여 투자할 수 있는 집합투자기구의 집합투자재산을 파생상품에 운용하는 경우에는 계약금액, 그 밖에 대통령령으로 정하는 위험에 관한 지표를 인터넷 홈페이지 등을 이용하여 공시하여야 한다. 이 경우 그 집합투자기구의 투자설명서(제123조제1항에 따른 투자설명서를 말한다)에 해당 위험에 관한 지표의 개요 및 위험에 관한 지표가 공시된다는 사실을 기재하여야 한다.

② 집합투자업자는 장외파생상품 매매에 따른 위험평가액이 대통령령으로 정하는 기준을 초과하여 투자할 수 있는 집합투자기구의 집합투자재산을 장외파생상품에 운용하는 경우에는 장외파생상품 운용에 따른 위험관리방법을 작성하여 그 집합투자재산을 보관ㆍ관리하는 신탁업자의 확인을 받아 금융위원회에 신고하여야 한다. <개정 2008.2.29>
