장애인복지법 시행령 제33조의3(금융정보 등의 요청 및 제공)

① 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 법 제50조의2제2항에 따라 제출받은 동의 서면을 「사회복지사업법」 제6조의2제2항에 따른 정보시스템(이하 "정보시스템"이라 한다)을 통하여 보건복지부장관에게 제출하여야 한다. <개정 2015.12.15>

② 제1항에 따른 동의 서면을 제출받은 보건복지부장관은 법 제50조의3제1항에 따라 「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호에 따른 금융회사등이나 「신용정보의 이용 및 보호에 관한 법률」 제25조제2항제1호에 따른 종합신용정보집중기관(이하 "금융기관등"이라 한다)의 장에게 신청인과 그 가구원에 대한 법 제50조의2제2항제1호부터 제3호까지의 금융정보, 신용정보 및 보험정보(이하 "금융정보등"이라 한다)의 제공을 요청하는 경우에는 요청 내용에 다음 각 호의 사항을 포함하여야 한다. <개정 2020.8.4>

③ 제2항에 따라 금융정보등의 제공을 요청받은 금융기관등의 장이 보건복지부장관에게 해당 금융정보등을 제공할 때에는 제공 내용에 다음 각 호의 사항을 포함하여야 한다.

④ 보건복지부장관은 금융기관등의 장에게 해당 금융기관등이 가입한 협회, 연합회 또는 중앙회 등의 정보통신망을 이용하여 제2항에 따른 금융정보등을 제공하도록 요청할 수 있다.

⑤ 보건복지부장관은 제3항에 따라 금융기관등의 장으로부터 제공받은 금융정보등을 정보시스템을 통하여 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 통보하여야 한다. <개정 2015.12.15>

⑥ 법 제50조의3제2항에 따른 수급자와 그 가구원에 대한 금융정보등의 제공 요청에 관하여는 제2항부터 제4항까지의 규정을 준용한다. 이 경우 "신청인"은 "수급자"로 본다.
