전기통신사업법 제95조의2(벌칙)

1. 제4조의2제3항을 위반하여 재직 중에 알게 된 타인의 비밀을 누설한 사람

1의2. 제22조의5제1항에 따른 불법촬영물등의 삭제ㆍ접속차단 등 유통방지에 필요한 조치를 취하지 아니한 자. 다만, 불법촬영물등을 인식한 경우 지체 없이 해당 정보의 삭제ㆍ접속차단 등 유통방지에 필요한 조치를 취하기 위하여 상당한 주의를 게을리하지 아니하였거나 해당 정보의 삭제ㆍ접속차단 등 유통방지에 필요한 조치가 기술적으로 현저히 곤란한 경우에는 그러하지 아니하다.

2. 제32조의4제1항제1호를 위반하여 자금을 제공 또는 융통하여 주는 조건으로 다른 사람 명의의 이동통신단말장치를 개통하여 그 이동통신단말장치에 제공되는 전기통신역무를 이용하거나 해당 자금의 회수에 이용하는 행위를 한 자

3. 제32조의4제1항제2호를 위반하여 자금을 제공 또는 융통하여 주는 조건으로 이동통신단말장치 이용에 필요한 전기통신역무 제공에 관한 계약을 권유ㆍ알선ㆍ중개하거나 광고하는 행위를 한 자

3의2. 제32조의4제1항제3호를 위반하여 「형법」 제247조(도박장소 등 개설), 제347조(사기) 및 제347조의2(컴퓨터등 사용사기)의 죄에 해당하는 행위, 「성매매알선 등 행위의 처벌에 관한 법률」 제2조제1항제2호 및 제3호에 따른 성매매알선 등 행위 및 성매매 목적의 인신매매에 이용할 목적으로 다른 사람 명의의 이동통신단말장치를 개통하여 그 이동통신단말장치에 제공되는 전기통신역무를 이용하는 행위를 한 자

4. 제84조의2제1항을 위반하여 다른 사람을 속여 재산상 이익을 취하거나 폭언ㆍ협박ㆍ희롱 등의 위해를 입힐 목적으로 전화(문자메시지를 포함한다)를 하면서 송신인의 전화번호를 변작하는 등 거짓으로 표시한 자
