Enforcement Decree of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Article 35-4 (Scope of Content Posters Subject to Aggravated Damages)

법 제44조의10제3항 각 호 외의 부분에서 "대통령령으로 정하는 기준에 해당하는 자"란 불법정보 또는 허위조작정보(법 제44조의7제2항 각 호 외의 부분 본문에 따른 허위조작정보를 말한다. 이하 같다)를 정보통신망에 유통할 당시(해당 정보를 정보통신망에 게재한 날을 말한다) 다음 각 호의 요건에 모두 해당하는 자를 말한다.

가. 구독자 및 이에 준하는 자의 수가 10만 명 이상인 자

나. 직전 3개월 동안 게시한 정보의 월별 합산 조회 수의 평균이 10만 회 이상인 자
