정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제3조(정의)

1. "정신질환자"란 망상, 환각, 사고(思考)나 기분의 장애 등으로 인하여 독립적으로 일상생활을 영위하는 데 중대한 제약이 있는 사람을 말한다.

2. "정신건강증진사업"이란 정신건강 관련 교육ㆍ상담, 정신질환의 예방ㆍ치료, 정신질환자의 재활, 정신건강에 영향을 미치는 사회복지ㆍ교육ㆍ주거ㆍ근로 환경의 개선 등을 통하여 국민의 정신건강을 증진시키는 사업을 말한다.

3. "정신건강복지센터"란 정신건강증진시설, 「사회복지사업법」에 따른 사회복지시설(이하 "사회복지시설"이라 한다), 학교 및 사업장과 연계체계를 구축하여 지역사회에서의 정신건강증진사업 및 제33조부터 제38조까지, 제38조의2ㆍ제38조의3에 따른 정신질환자 복지서비스 지원사업(이하 "정신건강증진사업등"이라 한다)을 하는 다음 각 목의 기관 또는 단체를 말한다.

4. "정신건강증진시설"이란 정신의료기관, 정신요양시설 및 정신재활시설을 말한다.

5. "정신의료기관"이란 다음 각 목의 어느 하나에 해당하는 기관을 말한다.

6. "정신요양시설"이란 제22조에 따라 설치된 시설로서 정신질환자를 입소시켜 요양 서비스를 제공하는 시설을 말한다.

7. "정신재활시설"이란 제26조에 따라 설치된 시설로서 정신질환자 또는 정신건강상 문제가 있는 사람 중 대통령령으로 정하는 사람(이하 "정신질환자등"이라 한다)의 사회적응을 위한 각종 훈련과 생활지도를 하는 시설을 말한다.

8. "동료지원인"이란 정신질환자등에 대한 상담 및 교육 등의 역할을 수행할 수 있도록 정신질환자이거나 정신질환자이었던 사람 중 보건복지부령으로 정하는 동료지원인 양성과정을 수료한 사람을 말한다.
