Political Funds Act, Article 28 (Restrictions on Use of Subsidies, Etc.)
①보조금은 정당의 운영에 소요되는 경비로서 다음 각 호에 해당하는 경비 외에는 사용할 수 없다.
(1) Subsidies may not be used except for the following expenses required to run a political party:
1. 인건비
1. Personnel expenses;
2. 사무용 비품 및 소모품비
2. Office equipment and supplies;
3. 사무소 설치ㆍ운영비
3. Expenses for setting up and running offices;
4. 공공요금
4. Public utility charges;
5. 정책개발비
5. Policy development expenses;
6. 당원 교육훈련비
6. Education and training expenses for party members;
7. 조직활동비
7. Organizational activity expenses;
8. 선전비
8. Publicity expenses;
9. 선거관계비용
9. Election-related expenses.
②경상보조금을 지급받은 정당은 그 경상보조금 총액의 100분의 30 이상은 정책연구소 [「정당법」 제38조(정책연구소의 설치ㆍ운영)에 의한 정책연구소를 말한다. 이하 같다]에, 100분의 10 이상은 시ㆍ도당에 배분ㆍ지급하여야 하며, 100분의 10 이상은 여성정치발전을 위하여, 100분의 5 이상은 청년정치발전을 위하여 사용하여야 한다. 이 경우 여성정치발전을 위한 경상보조금의 구체적인 사용 용도는 다음 각 호와 같다. <개정 2022.2.22, 2024.1.2>
(2) A political party that receives ordinary subsidies shall distribute and pay at least 30/100 of the total ordinary subsidies to its policy research institute [meaning a policy research institute under Article 38 (Establishment and Operation of Policy Research Institutes) of the Political Parties Act; the same applies hereinafter] and at least 10/100 to its Si/Do party chapters, and shall use at least 10/100 for the political advancement of women and at least 5/100 for the political advancement of young people. In this case, the specific uses of ordinary subsidies for the political advancement of women are as follows:
1. 여성정책 관련 정책개발비
1. Policy development expenses related to policies on women;
2. 여성 공직선거 후보자 지원 선거관계경비
2. Election-related expenses to support women candidates in elections for public office;
3. 여성정치인 발굴 및 교육 관련 경비
3. Expenses related to finding and educating women politicians;
4. 양성평등의식 제고 등을 위한 당원 교육 관련 경비
4. Expenses related to educating party members, such as to raise awareness of gender equality;
5. 여성 국회의원ㆍ지방의회의원 정치활동 지원 관련 경비
5. Expenses related to supporting the political activities of women members of the National Assembly and local councils;
6. 그 밖에 여성정치발전에 필요한 활동비, 인건비 등의 경비로서 중앙선거관리위원회규칙으로 정하는 경비
6. Other expenses necessary for the political advancement of women, such as activity expenses and personnel expenses, prescribed by National Election Commission Regulations.
③정당은 소속 당원인 공직선거의 후보자ㆍ예비후보자에게 보조금을 지원할 수 있으며, 제1항에도 불구하고 여성추천보조금은 여성후보자의, 장애인추천보조금은 장애인후보자의, 청년추천보조금은 청년후보자의 선거경비로 사용하여야 한다. <개정 2010.1.25, 2022.2.22>
(3) A political party may provide subsidies to candidates and preliminary candidates in elections for public office who are its members. Notwithstanding paragraph (1), subsidies for nominating women shall be used for the election expenses of women candidates, subsidies for nominating persons with disabilities for those of candidates with disabilities, and subsidies for nominating young people for those of young candidates.
④각급 선거관리위원회(읍ㆍ면ㆍ동선거관리위원회를 제외한다) 위원ㆍ직원은 보조금을 지급받은 정당 및 이의 지출을 받은 자 그 밖에 관계인에 대하여 감독상 또는 이 법의 위반 여부를 확인하기 위하여 필요하다고 인정하는 때에는 보조금 지출에 관하여 조사할 수 있다.
(4) Members and employees of election commissions at each level (excluding Eup/Myeon/Dong election commissions) may investigate the spending of subsidies with respect to the political parties that received them, persons who received payments from them, and other related persons, when they consider it necessary for supervision or to check for violations of this Act.
