주택법 제11조의6(조합 가입 철회 및 가입비 등의 반환)

① 모집주체는 주택조합의 가입을 신청한 자가 주택조합 가입을 신청하는 때에 납부하여야 하는 일체의 금전(이하 "가입비등"이라 한다)을 대통령령으로 정하는 기관(이하 "예치기관"이라 한다)에 예치하도록 하여야 한다. <개정 2020.1.23>

② 주택조합의 가입을 신청한 자는 가입비등을 예치한 날부터 30일 이내에 주택조합 가입에 관한 청약을 철회할 수 있다.

(2) An앤 applicant애플리컨트 for^f포 membership멤버쉽 of어^v브 a어 housing하우징 association어소우시에이션 may메이 withdraw위^ð드드^r로 the^ð디 application애플러케이션 to투 join조인 the^ð더 housing하우징 association어소우시에이션 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 the^ð더 membership멤버쉽 fees,^f피즈 etc.엣세터^r러 were워 deposited.더파지티드

③ 청약 철회를 서면으로 하는 경우에는 청약 철회의 의사를 표시한 서면을 발송한 날에 그 효력이 발생한다.

④ 모집주체는 주택조합의 가입을 신청한 자가 청약 철회를 한 경우 청약 철회 의사가 도달한 날부터 7일 이내에 예치기관의 장에게 가입비등의 반환을 요청하여야 한다.

(4) Where웨어 an앤 applicant애플리컨트 for^f포 membership멤버쉽 of어^v브 a어 housing하우징 association어소우시에이션 withdraws위^ð드드^r로즈 the^ð디 application,애플러케이션 the^ð더 recruiting^r러크^r루팅 entity엔터티 shall섈 request^r리퀘스트 the^ð더 head헤드 of어^v브 the^ð더 depository디파저토^r리 institution인스티투션 to투 return^r리턴 the^ð더 membership멤버쉽 fees,^f피즈 etc.엣세터^r러 within위^ð딘 seven세^v븐 days데이즈 from^f프^r럼 the^ð더 date데잇 the^ð디 intention인텐천 to투 withdraw위^ð드드^r로 reaches^r리치즈 it.잇

⑤ 예치기관의 장은 제4항에 따른 가입비등의 반환 요청을 받은 경우 요청일부터 10일 이내에 그 가입비등을 예치한 자에게 반환하여야 한다.

(5) Upon어판 receiving^r러시^v빙 a어 request^r리퀘스트 to투 return^r리턴 membership멤버쉽 fees,^f피즈 etc.엣세터^r러 under언더 paragraph패^r러그^r래^f프 (4), the^ð더 head헤드 of어^v브 the^ð더 depository디파저토^r리 institution인스티투션 shall섈 return^r리턴 them^ð뎀 to투 the^ð더 person퍼슨 who후 deposited더파지티드 them^ð뎀 within위^ð딘 ten텐 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 the^ð더 request.^r리퀘스트

⑥ 모집주체는 주택조합의 가입을 신청한 자에게 청약 철회를 이유로 위약금 또는 손해배상을 청구할 수 없다.

(6) A어 recruiting^r러크^r루팅 entity엔터티 may메이 not낫 claim클레임 a어 penalty페널티 or오 damages대머지즈 from^f프^r럼 an앤 applicant애플리컨트 for^f포 membership멤버쉽 of어^v브 a어 housing하우징 association어소우시에이션 on안 the^ð더 ground그^r라운드 of어^v브 withdrawal위^ð드드^r로얼 of어^v브 the^ð디 application.애플러케이션

⑦ 제2항에 따른 기간 이내에는 제11조제8항 및 제9항을 적용하지 않는다.

(7) Article아터클 11 (8) and앤드 (9) shall섈 not낫 apply어플라이 within위^ð딘 the^ð더 period피^r리어드 under언더 paragraph패^r러그^r래^f프 (2).

⑧ 제1항에 따라 예치된 가입비등의 관리, 지급 및 반환과 제2항에 따른 청약 철회의 절차 및 방법 등에 관한 사항은 대통령령으로 정한다.
