Local Tax Act, Article 98 (Occasional Assessment)
(1) Where a resident falls under any of the following subparagraphs during a taxable period, the head of the local government having jurisdiction over the place of tax payment may impose the individual local income tax on the resident at any time (hereinafter referred to as "occasional assessment" in this Article):
1. Where the resident has suspended or closed business for a long period due to poor business or other reasons and is deemed likely to evade the individual local income tax;
2. Where there are other substantial reasons to believe the resident is likely to evade taxes.
(2) Paragraph (1) shall apply with the period from the commencement date of the taxable period to the date on which the reason for occasional assessment arises as the occasional assessment period. In such cases, where the reason arises before the filing deadline under Article 95 and the resident has not filed a final return of the tax base for the preceding taxable period, the preceding taxable period shall be included in the occasional assessment period.
(3) Where the individual local income tax is occasionally assessed under paragraph (1), Articles 53 and 54 of the Framework Act on Local Taxes shall not apply to that tax.
(4) Matters necessary for occasional assessment under paragraphs (1) and (2) shall be prescribed by Presidential Decree.
