지방자치법 제63조(의장 등을 선거할 때의 의장 직무 대행)

제57조제1항, 제60조 또는 제61조제1항에 따른 선거(이하 이 조에서 "의장등의 선거"라 한다)를 실시할 때 의장의 직무를 수행할 사람이 없으면 출석의원 중 최다선의원이, 최다선의원이 2명 이상이면 그 중 연장자가 그 직무를 대행한다. 이 경우 직무를 대행하는 지방의회의원이 정당한 사유 없이 의장등의 선거를 실시할 직무를 이행하지 아니할 때에는 다음 순위의 지방의회의원이 그 직무를 대행한다.
