출입국관리법 제71조(출입국의 정지 등)

① 지방출입국ㆍ외국인관서의 장은 제69조제3항에 따른 심사 결과 위법한 사실을 발견하였을 때에는 관계 승무원 또는 승객의 출국이나 입국을 정지시킬 수 있다. <개정 2014.3.18>

② 제1항에 따른 출입국의 정지는 위법한 사실의 조사에 필요한 기간에만 할 수 있다.

③ 제2항에 따른 조사를 마친 뒤에도 계속하여 출입국을 금지하거나 정지시킬 필요가 있을 때에는 제4조ㆍ제11조 또는 제29조에 따른 법무부장관의 결정을 받아야 한다.

④ 지방출입국ㆍ외국인관서의 장은 제1항, 제4조 또는 제29조에 따라 승객이나 승무원의 출국을 금지하거나 정지시키기 위하여 필요하다고 인정하면 선박등에 대하여 출항의 일시정지 또는 회항(回航)을 명하거나 선박등에 출입하는 것을 제한할 수 있다. <개정 2014.3.18>

⑤ 지방출입국ㆍ외국인관서의 장은 제4항에 따라 선박등에 대하여 출항의 일시정지 또는 회항을 명하거나 출입을 제한하는 경우에는 지체 없이 그 사실을 선박등의 장이나 운수업자에게 통보하여야 한다. 출항의 일시정지ㆍ회항명령 또는 출입제한을 해제한 경우에도 또한 같다. <개정 2014.3.18>

⑥ 제4항에 따른 선박등의 출항의 일시정지 등은 직무수행에 필요한 최소한의 범위에서 하여야 한다.
