학원의 설립ㆍ운영 및 과외교습에 관한 법률 제10조(휴원 및 폐원 등의 신고)

① 학원설립ㆍ운영자는 그 학원을 1개월 이상 휴원(休院)하거나 폐원하려면 교육부령으로 정하는 바에 따라 지체 없이 교육감에게 신고하여야 한다. <개정 2008.2.29, 2013.3.23, 2017.12.19>

② 교육감은 학원설립ㆍ운영자가 「부가가치세법」 제8조에 따라 관할 세무서장에게 폐업신고를 하거나 관할 세무서장이 사업자등록을 말소한 경우에는 등록 사항을 직권으로 말소할 수 있다. <신설 2017.12.19>

③ 교육감은 제2항의 직권 말소를 위하여 필요한 경우 관할 세무서장에게 학원설립ㆍ운영자의 폐업여부에 대한 정보 제공을 요청할 수 있다. 이 경우 요청을 받은 관할 세무서장은 「전자정부법」 제36조제1항에 따라 학원설립ㆍ운영자의 폐업여부에 대한 정보를 제공하여야 한다. <신설 2017.12.19>

④ 학원설립ㆍ운영자는 제17조제1항에 따른 행정처분 기간과 그 처분을 위한 절차가 진행 중인 기간(「행정절차법」 제21조에 따른 처분의 사전 통지 시점부터 처분이 확정되기 전까지의 기간을 말한다) 중에는 제1항에 따른 폐원신고를 할 수 없다. <신설 2023.4.18>
