Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Lessons, Article 17 (Administrative Dispositions)

① 교육감은 학원이 다음 각 호의 어느 하나에 해당하면 그 등록을 말소하거나 1년 이내의 기간을 정하여 교습과정의 전부 또는 일부에 대한 교습의 정지를 명할 수 있다. 다만, 제1호에 해당하는 경우에는 그 등록을 말소하여야 한다. <개정 2011.7.25, 2015.2.3, 2016.5.29, 2016.12.20, 2023.4.18, 2026.3.31>

12. 학습자에 대한 「아동복지법」 제3조제7호에 따른 아동학대 행위가 확인된 경우. 다만, 학원설립ㆍ운영자가 아동학대 행위를 방지하기 위하여 상당한 주의와 감독을 게을리하지 아니한 경우는 제외한다.

② 교육감은 교습소가 다음 각 호의 어느 하나에 해당하면 그 교습소의 폐지를 명하거나 6개월 이내의 기간을 정하여 교습의 정지를 명할 수 있다. 다만, 제1호의2에 해당하는 경우에는 그 교습소의 폐지를 명하여야 한다. <개정 2011.7.25, 2016.5.29, 2016.12.20, 2023.4.18, 2026.3.31>

③ 교육감은 개인과외교습자가 다음 각 호의 어느 하나에 해당하는 경우 1년 이내의 기간을 정하여 과외교습 중지를 명할 수 있다. 다만, 제1호의2에 해당하는 경우에는 과외교습 중지를 명하여야 한다. <신설 2008.3.28, 2011.7.25, 2016.5.29, 2026.3.31>
