Framework Act on the Construction Industry, Article 85-2 (Succession to the Status of Construction Business Operators)

① 제20조의2에 따른 폐업신고로 건설업 등록이 말소된 자가 제9조에 따라 6개월 이내에 다시 건설사업자로 등록한 경우로서 다음 각 호의 어느 하나에 해당하는 경우에는 그 건설사업자는 폐업신고 전의 건설사업자의 지위를 승계한다. <개정 2012.6.1, 2016.2.3, 2019.4.30>

1. 말소 당시에 등록한 업종과 동일한 업종의 건설업을 다시 등록하는 경우

② 제1항에 따라 건설사업자의 지위를 승계한 자에 대하여는 폐업신고 전의 건설사업자에 대한 행정처분의 효과가 승계된다. <개정 2019.4.30>

③ 국토교통부장관은 제1항에 따라 폐업신고 전의 건설사업자의 지위를 승계한 자에 대하여 폐업신고 전의 위반행위를 사유로 제81조, 제82조, 제82조의2 및 제83조에 따른 시정명령, 영업정지 또는 등록말소 등을 할 수 있다. <개정 2013.3.23, 2019.4.30>
