Public Official Election Act, Article 122-2 (Reimbursement of Election Expenses, etc.)
①선거구선거관리위원회는 다음 각호의 규정에 따라 후보자(대통령선거의 정당추천후보자와 비례대표국회의원선거 및 비례대표지방의회의원선거에 있어서는 후보자를 추천한 정당을 말한다. 이하 이 조에서 같다)가 이 법의 규정에 의한 선거운동을 위하여 지출한 선거비용[「정치자금법」 제40조(회계보고)의 규정에 따라 제출한 회계보고서에 보고된 선거비용으로서 정당하게 지출한 것으로 인정되는 선거비용을 말한다]을 제122조(선거비용제한액의 공고)의 규정에 의하여 공고한 비용의 범위안에서 대통령선거 및 국회의원선거에 있어서는 국가의 부담으로, 지방자치단체의 의회의원 및 장의 선거에 있어서는 당해 지방자치단체의 부담으로 선거일후 보전한다. <개정 2004.3.12, 2005.8.4>
(1) A constituency election commission shall, after election day, reimburse a candidate (for a party-recommended candidate in a presidential election, and in a proportional representation National Assembly election and a proportional representation local council election, this means the political party that recommended the candidate; the same shall apply hereinafter in this Article) for the election expenses spent on election campaigns under this Act [meaning election expenses reported in the accounting report submitted under Article 40 (Accounting Reports) of the Political Funds Act that are recognized as properly spent], within the amount announced under Article 122 (Public Announcement of the Limit on Election Expenses), as follows: at the expense of the State in a presidential election and a National Assembly election, and at the expense of the relevant local government in elections of members and heads of local governments:
1. 대통령선거, 지역구국회의원선거, 지역구지방의회의원선거 및 지방자치단체의 장선거
1. Presidential election, constituency National Assembly election, constituency local council election and election of the head of a local government
가. 후보자가 당선되거나 사망한 경우 또는 후보자의 득표수가 유효투표총수의 100분의 15 이상인 경우
(a) Where the candidate is elected or dies, or where the candidate's votes are at least 15/100 of the total valid votes:
후보자가 지출한 선거비용의 전액
The full amount of the election expenses spent by the candidate;
나. 후보자의 득표수가 유효투표총수의 100분의 10 이상 100분의 15 미만인 경우
(b) Where the candidate's votes are at least 10/100 but less than 15/100 of the total valid votes:
후보자가 지출한 선거비용의 100분의 50에 해당하는 금액
An amount equal to 50/100 of the election expenses spent by the candidate;
2. 비례대표국회의원선거 및 비례대표지방의회의원선거후보자명부에 올라 있는 후보자중 당선인이 있는 경우에 당해 정당이 지출한 선거비용의 전액
2. Proportional representation National Assembly election and proportional representation local council election: Where any candidate on the list of candidates is elected, the full amount of the election expenses spent by the political party.
②제1항에 따른 선거비용의 보전에 있어서 다음 각 호의 어느 하나에 해당하는 비용은 이를 보전하지 아니한다. <신설 2005.8.4, 2010.1.25, 2011.7.28>
(2) In reimbursing election expenses under paragraph (1), expenses falling under any of the following subparagraphs shall not be reimbursed:
1. 예비후보자의 선거비용
1. Election expenses of preliminary candidates;
2. 「정치자금법」 제40조(회계보고)의 규정에 따라 제출한 회계보고서에 보고되지 아니하거나 허위로 보고된 비용
2. Expenses not reported, or falsely reported, in the accounting report submitted under Article 40 (Accounting Reports) of the Political Funds Act;
3. 이 법에 위반되는 선거운동을 위하여 또는 기부행위제한규정을 위반하여 지출된 비용
3. Expenses spent on election campaigns that violate this Act or in violation of the provisions restricting contributions;
4. 제64조 또는 제65조에 따라 선거벽보와 선거공보를 관할 구ㆍ시ㆍ군선거관리위원회에 제출한 후 그 내용을 정정하거나 삭제하는데 소요되는 비용
4. Expenses for correcting or deleting the content of election posters and election bulletins after they have been submitted to the competent Gu/Si/Gun election commission under Article 64 or 65;
5. 이 법에 따라 제공하는 경우 외에 선거운동과 관련하여 지출된 수당ㆍ실비 그 밖의 비용
5. Allowances, actual expenses and other expenses spent in connection with election campaigns other than those provided under this Act;
6. 정당한 사유 없이 지출을 증빙하는 적법한 영수증 그 밖의 증빙서류가 첨부되지 아니한 비용
6. Expenses without lawful receipts or other supporting documents proving the expenditure attached, without a justifiable reason;
7. 후보자가 자신의 차량ㆍ장비ㆍ물품 등을 사용하거나 후보자의 가족ㆍ소속 정당 또는 제3자의 차량ㆍ장비ㆍ물품 등을 무상으로 제공 또는 대여받는 등 정당 또는 후보자가 실제로 지출하지 아니한 비용
7. Expenses not actually spent by the political party or candidate, such as where the candidate uses his or her own vehicles, equipment, goods, etc., or receives vehicles, equipment, goods, etc. of the candidate's family, political party or a third party free of charge or on free loan;
8. 청구금액이 중앙선거관리위원회규칙으로 정하는 기준에 따라 산정한 통상적인 거래가격 또는 임차가격과 비교하여 정당한 사유 없이 현저하게 비싸다고 인정되는 경우 그 초과하는 가액의 비용
8. Where the amount claimed is found to be considerably higher, without a justifiable reason, than the ordinary transaction price or rental price calculated according to the standards prescribed by the Rules of the National Election Commission, the excess amount;
9. 선거운동에 사용하지 아니한 차량ㆍ장비ㆍ물품 등의 임차ㆍ구입ㆍ제작비용
9. Costs of renting, buying or making vehicles, equipment, goods, etc. not used for election campaigns;
10. 휴대전화 통화료와 정보이용요금. 다만, 후보자와 그 배우자, 선거사무장, 선거연락소장 및 회계책임자가 선거운동기간 중 선거운동을 위하여 사용한 휴대전화 통화료 중 후보자가 부담하는 통화료는 보전한다.
10. Mobile phone call charges and information usage fees. However, among the mobile phone call charges for phones used for election campaigns during the election campaign period by the candidate and his or her spouse, the election campaign manager, heads of election liaison offices and the accounting officer, the call charges borne by the candidate shall be reimbursed;
11. 그 밖에 위 각 호의 어느 하나에 준하는 비용으로서 중앙선거관리위원회규칙으로 정하는 비용
11. Other expenses equivalent to any of the above subparagraphs, as prescribed by the Rules of the National Election Commission.
③다음 각 호의 어느 하나에 해당하는 비용은 국가 또는 지방자치단체가 후보자를 위하여 부담한다. 이 경우 제3호의2 및 제5호의 비용은 국가가 부담한다. <개정 2004.3.12, 2005.8.4, 2007.1.3, 2008.2.29, 2010.1.25, 2014.1.17, 2015.8.13, 2020.12.29, 2022.4.20>
(3) The State or local governments shall bear the following expenses on behalf of candidates. In this case, the expenses under subparagraphs 3-2 and 5 shall be borne by the State:
1. 제64조에 따른 선거벽보의 첩부 및 철거의 비용(첩부 및 철거로 인한 원상복구 비용을 포함한다)
1. The costs of posting and removing election posters under Article 64 (including the costs of restoring places to their original condition after posting and removal);
2. 제65조에 따른 점자형 선거공보(같은 조 제11항에 따라 후보자가 제출하는 저장매체를 포함한다. 이하 이 항에서 같다)의 작성비용과 책자형 선거공보(점자형 선거공보 및 같은 조 제9항의 후보자정보공개자료를 포함한다) 및 전단형 선거공보의 발송비용과 우편요금
2. The costs of preparing braille election bulletins under Article 65 (including storage media submitted by candidates under paragraph (11) of the same Article; the same shall apply hereinafter in this paragraph), and the sending costs and postage for booklet-type election bulletins (including braille election bulletins and the candidate disclosure information under paragraph (9) of the same Article) and leaflet-type election bulletins;
3. 제66조(선거공약서)제8항의 규정에 따른 점자형 선거공약서의 작성비용
3. The costs of preparing braille election pledge books under Article 66 (Election Pledge Books) (8);
3의2. 활동보조인(예비후보자로서 선임하였던 활동보조인을 포함한다)의 수당, 실비 및 산재보험료
3-2. Allowances, actual expenses and industrial accident insurance premiums of activity assistants (including activity assistants appointed while the candidate was a preliminary candidate);
4. 제82조의2(선거방송토론위원회 주관 대담ㆍ토론회)의 규정에 의한 대담ㆍ토론회(합동방송연설회를 포함한다)의 개최비용
4. The costs of holding talks and debates (including joint broadcast speech meetings) under Article 82-2 (Talks and Debates Organized by Election Broadcast Debate Commissions);
5. 제82조의3(선거방송토론위원회 주관 정책토론회)의 규정에 의한 정책토론회의 개최비용
5. The costs of holding policy debates under Article 82-3 (Policy Debates Organized by Election Broadcast Debate Commissions);
6. 제161조(投票參觀)의 규정에 의한 투표참관인 및 제162조에 따른 사전투표참관인의 수당과 식비
6. Allowances and meal expenses of voting observers under Article 161 (Observation of Voting) and early voting observers under Article 162;
7. 제181조(開票參觀)의 규정에 의한 개표참관인의 수당과 식비

④ 제3항제6호에 따른 투표참관인 및 사전투표참관인 수당은 10만원으로 하고, 같은 항 제7호에 따른 개표참관인 수당은 10만원으로 한다. 이 경우 투표참관인 및 사전투표참관인의 수당과 개표참관 도중 개표참관인을 교체하는 경우의 수당은 6시간 이상 출석한 사람에게만 지급한다. <신설 2022.4.20>
(4) The allowance for voting observers and early voting observers under paragraph (3) 6 shall be 100,000 won, and the allowance for vote counting observers under subparagraph 7 of the same paragraph shall be 100,000 won. In this case, the allowance for voting observers and early voting observers, and the allowance where a vote counting observer is replaced during the observation of vote counting, shall be paid only to persons who attended for six hours or more.
⑤제1항 내지 제3항의 규정에 따른 비용의 산정 및 보전청구 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <개정 2005.8.4, 2022.4.20>
(5) The calculation of expenses and claims for reimbursement under paragraphs (1) through (3), and other necessary matters, shall be prescribed by the Rules of the National Election Commission.
