기초연금법 제8조(기초연금액의 감액)

① 본인과 그 배우자가 모두 기초연금 수급권자인 경우에는 각각의 기초연금액에서 기초연금액의 100분의 20에 해당하는 금액을 감액한다.

② 소득인정액과 제5조, 제5조의2, 제6조 및 제7조에 따른 기초연금액(제1항이 적용되는 경우에는 그 감액분이 반영된 금액을 말한다)을 합산한 금액이 선정기준액 이상인 경우에는 선정기준액을 초과하는 금액의 범위에서 기초연금액의 일부를 감액할 수 있다. <개정 2019.1.15>

③ 제5조의2의 적용을 받는 기초연금 수급권자의 소득인정액과 해당 기초연금액(제8조제1항이 적용되는 경우에는 그 감액분이 반영된 금액을 말한다)을 합산한 금액이 저소득자 선정기준액과 기준연금액(제5조의2에 해당하지 않는 기초연금 수급권자의 기준연금액을 말한다)을 합산한 금액 이상인 경우에는 제5조의2의 적용을 받는 기초연금 수급권자의 기초연금액의 일부를 감액할 수 있다. <신설 2019.1.15>
