도로교통법 시행령 제62조(조건부 등록)

① 법 제100조에 따라 학원의 조건부 등록(이하 "조건부등록"이라 한다)을 신청하려는 자는 제60조제1항 각 호의 사항을 적은 조건부등록 신청서에 학원의 운영 등에 관한 원칙을 적은 서류 등 행정안전부령으로 정하는 서류를 첨부하여 시ㆍ도경찰청장에게 제출하여야 한다. <개정 2014.11.19, 2017.7.26, 2020.12.31>

② 시ㆍ도경찰청장은 제1항에 따른 신청내용을 검토한 결과 1년 이내에 제63조제1항에 따른 시설 및 설비 등의 기준을 갖출 수 있을 것으로 인정되면 1년 이내에 그 기준을 갖출 것을 조건으로 하여 조건부등록을 받을 수 있다. <개정 2020.12.31>

③ 조건부등록을 한 자가 제2항에 따른 기간 이내에 시설 및 설비 등을 갖출 수 없는 부득이한 사유로 조건부등록 기간의 연장을 신청한 경우 시ㆍ도경찰청장은 한 차례만 6개월의 범위에서 그 기간을 연장할 수 있다. <개정 2020.12.31>

④ 조건부등록을 한 자는 제2항 및 제3항에 따른 기간 만료 후 10일 이내에 시설ㆍ설비 완성신고서에 행정안전부령으로 정하는 서류를 첨부하여 시ㆍ도경찰청장에게 제출하여야 한다. <개정 2014.11.19, 2017.7.26, 2020.12.31>

⑤ 시ㆍ도경찰청장은 제4항에 따른 신고를 받은 경우 그 내용이 등록기준에 적합한지 확인하고, 적합하면 행정안전부령으로 정하는 바에 따라 등록증을 내주어야 한다. <개정 2014.11.19, 2017.7.26, 2020.12.31>
