도시 및 주거환경정비법 제118조(정비사업의 공공지원)

① 시장ㆍ군수등은 정비사업의 투명성 강화 및 효율성 제고를 위하여 시ㆍ도조례로 정하는 정비사업에 대하여 사업시행 과정을 지원(이하 "공공지원"이라 한다)하거나 토지주택공사등, 신탁업자, 「주택도시기금법」에 따른 주택도시보증공사 또는 이 법 제102조제1항 각 호 외의 부분 단서에 따라 대통령령으로 정하는 기관에 공공지원을 위탁할 수 있다.

② 제1항에 따라 정비사업을 공공지원하는 시장ㆍ군수등 및 공공지원을 위탁받은 자(이하 "위탁지원자"라 한다)는 다음 각 호의 업무를 수행한다.

③ 시장ㆍ군수등은 위탁지원자의 공정한 업무수행을 위하여 관련 자료의 제출 및 조사, 현장점검 등 필요한 조치를 할 수 있다. 이 경우 위탁지원자의 행위에 대한 대외적인 책임은 시장ㆍ군수등에게 있다.

④ 공공지원에 필요한 비용은 시장ㆍ군수등이 부담하되, 특별시장, 광역시장 또는 도지사는 관할 구역의 시장, 군수 또는 구청장에게 특별시ㆍ광역시 또는 도의 조례로 정하는 바에 따라 그 비용의 일부를 지원할 수 있다.

⑤ 추진위원회가 제2항제2호에 따라 시장ㆍ군수등이 선정한 정비사업전문관리업자를 선정하는 경우에는 제32조제2항을 적용하지 아니한다.

⑥ 공공지원의 시행을 위한 방법과 절차, 기준 및 제126조에 따른 도시ㆍ주거환경정비기금의 지원, 시공자 선정 시기 등에 필요한 사항은 시ㆍ도조례로 정한다.

⑦ 제6항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 토지등소유자(제35조에 따라 조합을 설립한 경우에는 조합원을 말한다)의 과반수 동의를 받아 제29조제4항에 따라 시공자를 선정할 수 있다. 다만, 제1호의 경우에는 해당 건설업자를 시공자로 본다. <개정 2017.8.9>

⑧ 제7항제1호의 협약사항에 관한 구체적인 내용은 시ㆍ도조례로 정할 수 있다.
