Enforcement Decree of the Act on the Improvement of Urban Areas and Residential Environments, Article 68 (Methods and Procedures for Acquiring Redevelopment Rental Housing)

① 법 제79조제5항에 따라 조합이 재개발사업의 시행으로 건설된 임대주택(이하 "재개발임대주택"이라 한다)의 인수를 요청하는 경우 시ㆍ도지사 또는 시장, 군수, 구청장이 우선하여 인수하여야 하며, 시ㆍ도지사 또는 시장, 군수, 구청장이 예산ㆍ관리인력의 부족 등 부득이한 사정으로 인수하기 어려운 경우에는 국토교통부장관에게 토지주택공사등을 인수자로 지정할 것을 요청할 수 있다.

② 법 제79조제5항에 따른 재개발임대주택의 인수 가격은 다음 각 호의 금액 또는 가격을 합한 금액으로 하며, 제2호에 따른 부속토지의 가격은 사업시행계획인가 고시가 있는 날을 기준으로 감정평가법인등 둘 이상이 평가한 금액을 산술평균한 금액으로 한다. <개정 2024.12.17>
