산업재해보상보험법 시행령 제27조(업무수행 중의 사고)

① 근로자가 다음 각 호의 어느 하나에 해당하는 행위를 하던 중에 발생한 사고는 법 제37조제1항제1호가목에 따른 업무상 사고로 본다.

② 근로자가 사업주의 지시를 받아 사업장 밖에서 업무를 수행하던 중에 발생한 사고는 법 제37조제1항제1호가목에 따른 업무상 사고로 본다. 다만, 사업주의 구체적인 지시를 위반한 행위, 근로자의 사적(私的) 행위 또는 정상적인 출장 경로를 벗어났을 때 발생한 사고는 업무상 사고로 보지 않는다.

③ 업무의 성질상 업무수행 장소가 정해져 있지 않은 근로자가 최초로 업무수행 장소에 도착하여 업무를 시작한 때부터 최후로 업무를 완수한 후 퇴근하기 전까지 업무와 관련하여 발생한 사고는 법 제37조제1항제1호가목에 따른 업무상 사고로 본다.
