아동ㆍ청소년의 성보호에 관한 법률 제25조의3(아동ㆍ청소년대상 디지털 성범죄 수사 특례의 절차)

① 사법경찰관리가 신분비공개수사를 진행하고자 할 때에는 사전에 상급 경찰관서 수사부서의 장의 승인을 받아야 한다. 이 경우 그 수사기간은 3개월을 초과할 수 없다.

② 제1항에 따른 승인의 절차 및 방법 등에 필요한 사항은 대통령령으로 정한다.

③ 사법경찰관리는 신분위장수사를 하려는 경우에는 검사에게 신분위장수사에 대한 허가를 신청하고, 검사는 법원에 그 허가를 청구한다.

④ 제3항의 신청은 필요한 신분위장수사의 종류ㆍ목적ㆍ대상ㆍ범위ㆍ기간ㆍ장소ㆍ방법 및 해당 신분위장수사가 제25조의2제2항의 요건을 충족하는 사유 등의 신청사유를 기재한 서면으로 하여야 하며, 신청사유에 대한 소명자료를 첨부하여야 한다.

⑤ 법원은 제3항의 신청이 이유 있다고 인정하는 경우에는 신분위장수사를 허가하고, 이를 증명하는 서류(이하 "허가서"라 한다)를 신청인에게 발부한다.

⑥ 허가서에는 신분위장수사의 종류ㆍ목적ㆍ대상ㆍ범위ㆍ기간ㆍ장소ㆍ방법 등을 특정하여 기재하여야 한다.

(6) A어 permit퍼밋 shall섈 specify스페서^f파이 the^ð더 type,타이프 purpose,퍼퍼스 target,타깃 scope,스코우프 period,피^r리어드 place,플레이스 method,메^θ써드 etc.엣세터^r러 of어^v브 the^ð더 disguised-identity디스가이즈드-아이덴티티 investigation.인^v베스터게이션

⑦ 신분위장수사의 기간은 3개월을 초과할 수 없으며, 그 수사기간 중 수사의 목적이 달성되었을 경우에는 즉시 종료하여야 한다.

⑧ 제7항에도 불구하고 제25조의2제2항의 요건이 존속하여 그 수사기간을 연장할 필요가 있는 경우에는 사법경찰관리는 소명자료를 첨부하여 3개월의 범위에서 수사기간의 연장을 검사에게 신청하고, 검사는 법원에 그 연장을 청구한다. 이 경우 신분위장수사의 총 기간은 1년을 초과할 수 없다.
