언론중재 및 피해구제 등에 관한 법률 제22조(직권조정결정)

① 당사자 사이에 합의(제19조제3항에 따라 합의한 것으로 보는 경우를 포함한다)가 이루어지지 아니한 경우 또는 신청인의 주장이 이유 있다고 판단되는 경우 중재부는 당사자들의 이익이나 그 밖의 모든 사정을 고려하여 신청취지에 반하지 아니하는 한도에서 직권으로 조정을 갈음하는 결정(이하 "직권조정결정"이라 한다)을 할 수 있다. 이 경우 그 결정은 제19조제2항에도 불구하고 조정신청 접수일부터 21일 이내에 하여야 한다.

② 직권조정결정서에는 주문(主文)과 결정 이유를 적고 이에 관여한 중재위원 전원이 서명ㆍ날인하여야 하며, 그 정본을 지체 없이 당사자에게 송달하여야 한다.

③ 직권조정결정에 불복하는 자는 결정 정본을 송달받은 날부터 7일 이내에 불복 사유를 명시하여 서면으로 중재부에 이의신청을 할 수 있다. 이 경우 그 결정은 효력을 상실한다.

④ 제3항에 따라 직권조정결정에 관하여 이의신청이 있는 경우에는 그 이의신청이 있은 때에 제26조제1항에 따른 소(訴)가 제기된 것으로 보며, 피해자를 원고로 하고 상대방인 언론사등을 피고로 한다.
