Infant Care Act, Article 15-5 (Prohibition, etc. of Viewing Video Information)

① 폐쇄회로 텔레비전을 설치ㆍ관리하는 자는 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 제15조의4제1항의 영상정보를 열람하게 하여서는 아니 된다. <개정 2021.6.8, 2023.12.26>

1. 보호자가 자녀 또는 보호아동의 안전을 확인할 목적으로 열람시기ㆍ절차 및 방법 등 교육부령으로 정하는 바에 따라 영상정보의 원본 또는 사본 등을 요청하는 경우

③ 어린이집을 설치ㆍ운영하는 자는 제15조의4제1항의 영상정보가 분실ㆍ도난ㆍ유출ㆍ변조 또는 훼손되지 아니하도록 내부 관리계획의 수립, 접속기록 보관 등 대통령령으로 정하는 바에 따라 안전성 확보에 필요한 기술적ㆍ관리적 및 물리적 조치를 하여야 한다.

④ 국가 및 지방자치단체는 어린이집에 설치한 폐쇄회로 텔레비전의 설치ㆍ관리와 그 영상정보의 열람으로 영유아 및 보육교직원 등 정보주체의 권리가 침해되지 아니하도록 설치ㆍ관리 및 열람 실태를 교육부령으로 정하는 바에 따라 매년 1회 이상 조사ㆍ점검하여야 한다. <개정 2023.12.26>

⑤ 누구든지 이 법의 규정에 따르지 아니하고는 제15조의4제1항의 영상정보를 유출ㆍ변조ㆍ훼손 또는 멸실하는 행위를 하여서는 아니 된다. <신설 2023.8.8>
