위치정보의 보호 및 이용 등에 관한 법률 제13조(등록의 취소 및 사업의 폐지ㆍ정지 등)
Act on the Protection, Use, etc. of Location Information, Article 13 (Revocation of Registration and Closure or Suspension of Business, etc.)
①방송미디어통신위원회는 위치정보사업자 및 위치기반서비스사업자(이하 "위치정보사업자등"이라 한다)가 다음 각 호의 어느 하나에 해당하는 때에는 등록 또는 인가의 취소, 사업의 폐지 또는 6개월 이내의 범위에서 기간을 정하여 사업의 전부 또는 일부의 정지(이하 "사업의 정지"라 한다)를 명할 수 있다. 다만, 제1호에 해당하는 때에는 등록 또는 인가를 취소하거나 사업의 폐지를 명하여야 한다. <개정 2008.2.29, 2015.2.3, 2018.4.17, 2020.6.9, 2021.10.19, 2025.10.1>
(1) Where a location information business operator or a location-based service business operator (hereinafter referred to as a "location information business operator, etc.") falls under any of the following subparagraphs, the Broadcasting, Media and Communications Commission may revoke its registration or authorization, order the closure of its business, or order the suspension of all or part of its business for a fixed period of up to six months (hereinafter referred to as "suspension of business"): Provided, That in the case of subparagraph 1, it shall revoke the registration or authorization or order the closure of the business:
1. 거짓이나 그 밖의 부정한 방법으로 제5조제1항ㆍ제2항 또는 제7조제1항에 따른 등록ㆍ변경등록 또는 인가를 받거나 제5조의2제1항, 제9조제1항 또는 제9조의2제1항 단서에 따른 신고를 한 때
1. Where it has obtained registration, registration of a change, or authorization under Article 5 (1) or (2) or 7 (1), or made a report under Article 5-2 (1), 9 (1), or the proviso to Article 9-2 (1), by fraud or other improper means;
1의2. 제5조제5항에 따라 부가된 등록조건을 이행하지 아니한 때
1-2. Where it fails to fulfill a registration condition attached under Article 5 (5);
2. 제8조제1항 또는 제11조제1항에 따른 휴업기간이 지난 후 정당한 사유없이 사업을 개시하지 아니한 때
2. Where it fails to start business without justifiable grounds after the period of suspension under Article 8 (1) or 11 (1) has passed;
3. 다음 각 목의 어느 하나에 해당하는 승인을 받지 아니하거나 신고를 하지 아니하고 6개월 이상 계속하여 사업을 하지 아니한 때
3. Where it has not conducted business for six consecutive months or more without obtaining any of the following approvals or making any of the following reports:
가. 제8조제1항제1호 또는 같은 조 제2항제1호에 따른 승인
(a) Approval under Article 8 (1) 1 or (2) 1 of the same Article;
나. 제8조제1항제2호 또는 같은 조 제2항제2호에 따른 신고
(b) A report under Article 8 (1) 2 or (2) 2 of the same Article;
다. 제11조제1항 전단 또는 같은 조 제2항 전단에 따른 신고
(c) A report under the former part of Article 11 (1) or the former part of paragraph (2) of the same Article;
4. 위치정보의 수집 관련 설비 또는 위치정보 보호 관련 기술적ㆍ관리적 조치에 중대한 변경이 발생하여 서비스를 지속적으로 제공할 수 없게 된 때
4. Where a serious change has occurred in the facilities related to the collection of location information or in the technical and managerial measures related to the protection of location information, making it impossible to continue providing services;
4의2. 다른 법률에 따라 관계 행정기관의 장이 등록취소 또는 사업의 정지를 요청한 때
4-2. Where the head of a relevant administrative agency has requested revocation of registration or suspension of business under other Acts;

②제1항에 따른 행정처분의 세부적인 기준은 그 위반행위의 유형과 위반의 정도 등을 참작하여 대통령령으로 정한다. <개정 2020.6.9>
(2) The detailed standards for administrative dispositions under paragraph (1) shall be prescribed by Presidential Decree, taking into account the type and severity of the violation and other factors.
