초ㆍ중등교육법 시행령 제40조의3(학생생활지도)

① 학교의 장과 교원은 법 제20조의2제1항에 따라 다음 각 호의 어느 하나에 해당하는 분야와 관련하여 조언, 상담, 주의, 훈육ㆍ훈계 등의 방법으로 학생을 지도할 수 있다. 이 경우 도구, 신체 등을 이용하여 학생의 신체에 고통을 가하는 방법을 사용해서는 안 된다. <개정 2026.2.19>

② 학교의 장과 교원은 법 제20조의2제3항에 따라 학생의 행위에 대하여 방어 및 보호를 위한 제지를 하는 경우 해당 학생을 피해 대상과 즉시 분리시키는 등 학생의 행동을 일시적으로 제지할 수 있는 방법으로 하되, 도구, 신체 등을 이용하여 학생의 신체에 고통을 가하는 방법을 사용해서는 안 된다. <신설 2026.2.19>
