학교폭력예방 및 대책에 관한 법률 제11조(교육감의 임무)

① 교육감은 시ㆍ도교육청에 학교폭력의 예방ㆍ대책 및 법률지원을 포함한 통합지원을 담당하는 전담부서를 설치ㆍ운영하여야 한다. <개정 2023.10.24>

② 교육감은 관할 구역 안에서 학교폭력이 발생한 때에는 해당 학교의 장 및 관련 학교의 장에게 그 경과 및 결과의 보고를 요구할 수 있다.

③ 교육감은 관할 구역 안의 학교폭력이 관할 구역 외의 학교폭력과 관련이 있는 때에는 그 관할 교육감과 협의하여 적절한 조치를 취하여야 한다.

④ 교육감은 학교의 장으로 하여금 학교폭력의 예방 및 대책에 관한 실시계획을 수립ㆍ시행하도록 하여야 한다.

⑤ 교육감은 제12조에 따른 심의위원회가 처리한 학교의 학교폭력빈도를 학교의 장에 대한 업무수행 평가에 부정적 자료로 사용하여서는 아니 된다. <개정 2019.8.20>

⑥ 교육감은 제17조제1항제8호에 따른 전학의 경우 그 실현을 위하여 필요한 조치를 취하여야 하며, 제17조제1항제9호에 따른 퇴학처분의 경우 해당 학생의 건전한 성장을 위하여 다른 학교 재입학 등의 적절한 대책을 강구하여야 한다. <개정 2012.1.26, 2012.3.21>

⑦ 교육감은 대책위원회 및 지역위원회에 관할 구역 안의 학교폭력의 실태 및 대책에 관한 사항을 보고하고 공표하여야 한다. 관할 구역 밖의 학교폭력 관련 사항 중 관할 구역 안의 학교와 관련된 경우에도 또한 같다. <개정 2012.1.26, 2012.3.21>

⑧ 교육감은 학교폭력의 실태를 파악하고 학교폭력에 대한 효율적인 예방대책을 수립하기 위하여 학교폭력 실태조사를 연 2회 이상 실시하고, 각 학교폭력 실태조사가 완료된 날부터 120일 이내에 그 결과를 공표하여야 한다. <신설 2012.3.21, 2015.12.22, 2025.11.11>

⑨ 교육감은 학교폭력 등에 관한 조사, 상담, 치유프로그램 운영, 학생 치유ㆍ회복을 위한 보호시설 운영, 법률지원을 포함한 통합지원 등을 위한 전문기관을 설치ㆍ운영하여야 한다. <신설 2012.3.21, 2023.10.24>

⑩ 교육감은 제14조제3항에 따른 전담기구 구성원의 학교폭력 관련 전문성 향상을 위한 교육 등을 실시할 수 있다. <신설 2023.10.24>

⑪ 교육감은 관할 구역에서 학교폭력이 발생한 때에 해당 학교의 장 또는 소속 교원이 그 경과 및 결과를 보고하면서 축소 및 은폐를 시도한 경우에는 「교육공무원법」 제50조 및 「사립학교법」 제62조에 따른 징계위원회에 징계의결을 요구하여야 한다. <신설 2012.3.21, 2021.3.23, 2023.10.24>

⑫ 교육감은 관할 구역에서 학교폭력의 예방 및 대책 마련에 기여한 바가 큰 학교 또는 소속 교원에게 상훈을 수여하거나 소속 교원의 근무성적 평정에 가산점을 부여할 수 있다. <신설 2012.3.21, 2023.10.24>

⑬ 교육감은 학교의 장 및 교감을 대상으로 학교폭력 예방 및 대책 등에 관한 교육을 매년 1회 이상 실시하여야 한다. <신설 2023.10.24>

⑭ 제1항에 따라 설치되는 전담부서의 구성과 제8항에 따라 실시하는 학교폭력 실태조사, 제9항에 따른 전문기관의 설치 및 제13항에 따른 교육의 실시에 필요한 사항은 대통령령으로 정한다. <개정 2012.3.21, 2023.10.24>
