행정절차법 시행령 제20조(문서의 열람등)
Enforcement Decree of the Administrative Procedures Act, Article 20 (Inspection, etc. of Documents)
①당사자등은 법 제37조제1항의 규정에 의하여 열람 또는 복사를 요청하고자 하는 때에는 문서로 하여야 하며, 전자적 형태로 열람을 요청하는 경우 행정청은 당사자등의 요청에 응하는 것이 현저히 곤란한 경우가 아닌 한 전자적 형태로 열람할 수 있도록 하여야 한다. 다만, 청문일에 필요에 의하여 문서를 열람 또는 복사하고자 하는 경우에는 구술로 요청할 수 있다. <개정 2003.6.23>
(1) Where the parties, etc. wish to request inspection or copying under Article 37 (1) of the Act, they shall do so in writing. Where they request inspection in electronic form, the administrative agency shall allow inspection in electronic form unless it is extremely difficult to comply with the request: Provided, That where they wish to inspect or copy documents as needed on the date of the hearing, they may make the request orally.
②행정청은 법 제37조제2항의 규정에 의하여 문서의 열람 또는 복사의 일시 및 장소를 지정한 때에는 요청자에게 그 사실을 통지하여야 한다.
(2) When the administrative agency has designated the date, time, and place for inspecting or copying documents under Article 37 (2) of the Act, it shall notify the person who made the request of that fact.
③법 제37조제4항의 규정에 의하여 열람 또는 복사를 요청할 수 있는 문서는 「행정업무의 운영 및 혁신에 관한 규정」 제3조제1호의 공문서를 말한다. <개정 2011.12.21, 2016.4.26, 2023.6.27>
(3) The documents that may be requested for inspection or copying under Article 37 (4) of the Act are official documents under Article 3, subparagraph 1 of the Regulations on the Operation and Innovation of Administrative Affairs.
④ 법 제37조제5항에 따른 문서의 복사에 드는 비용에 관하여는 「공공기관의 정보공개에 관한 법률 시행령」 제17조제1항ㆍ제2항 및 제6항을 준용한다. <개정 2022.7.11>
(4) Article 17 (1), (2), and (6) of the Enforcement Decree of the Official Information Disclosure Act shall apply mutatis mutandis to the costs of copying documents under Article 37 (5) of the Act.
