고용보험법 시행령 제43조(근로자의 직업능력 개발을 위한 지원)
Enforcement Decree of the Employment Insurance Act, Article 43 (Support for the Vocational Skills Development of Workers)
① 고용노동부장관은 법 제29조제1항에 따라 다음 각 호의 어느 하나에 해당하는 피보험자등이 「국민 평생 직업능력 개발법」 제2조제1호에 따른 직업능력개발훈련(이하 "직업능력개발훈련"이라 한다)을 수강한 경우에는 고용노동부령으로 정하는 바에 따라 필요한 비용의 전부나 일부를 지원할 수 있다. <개정 2009.3.12, 2010.7.12, 2010.12.31, 2011.9.15, 2012.1.13, 2013.12.24, 2015.6.30, 2017.6.27, 2019.6.25, 2021.12.31, 2022.2.17>
(1) Pursuant to Article 29 (1) of the Act, where any of the following insured persons, etc. attends vocational skills development training under Article 2, subparagraph 1 of the Lifelong Vocational Skills Development Act (hereinafter referred to as "vocational skills development training"), the Minister of Employment and Labor may subsidize all or part of the necessary costs as prescribed by Ordinance of the Ministry of Employment and Labor:
1. 우선지원대상기업에 고용된 피보험자등
1. Insured persons, etc. employed by an enterprise subject to priority support;
2. 법 제27조제2항 각 호의 어느 하나에 해당하는 피보험자등
2. Insured persons, etc. falling under any subparagraph of Article 27 (2) of the Act;
3. 자영업자인 피보험자등
3. Insured self-employed persons, etc.;
4. 직업안정기관의 장에게 취업훈련을 신청한 날부터 180일 이내에 이직 예정인 피보험자등
4. Insured persons, etc. scheduled to leave employment within 180 days from the date they applied for employment training to the head of an employment security office;
5. 경영상의 이유로 90일 이상 무급 휴직 중인 피보험자등
5. Insured persons, etc. on unpaid leave of absence for 90 days or more for managerial reasons;
6. 대규모기업에 고용된 사람으로서 45세 이상이거나 고용노동부장관이 정하여 고시하는 소득액 미만인 피보험자등
6. Insured persons, etc. employed by a large enterprise who are aged 45 or older or whose income is less than the amount determined and publicly notified by the Minister of Employment and Labor;
7. 법 제27조에 따라 사업주가 실시하는 직업능력개발훈련을 수강하지 못한 기간이 3년 이상인 피보험자등
7. Insured persons, etc. who have not attended vocational skills development training provided by a business owner under Article 27 of the Act for three years or more;
8. 「남녀고용평등과 일ㆍ가정 양립 지원에 관한 법률」 제19조에 따른 육아휴직 중인 피보험자등
8. Insured persons, etc. on childcare leave under Article 19 of the Equal Employment Opportunity and Work-Family Balance Assistance Act.
② 제1항에 따른 직업능력개발훈련에 드는 비용은 해당 훈련을 받는 피보험자등이나 훈련을 실시하는 기관에 지급할 수 있다. 다만, 훈련을 받는 피보험자등이 고용노동부장관이 정하는 바에 따라 「여신전문금융업법」 제2조제3호에 따른 신용카드(이하 "신용카드"라 한다)를 사용하여 훈련비용을 결제하고 신용카드를 발급한 신용카드업자가 그 훈련비용을 훈련을 실시하는 기관에 지급한 경우에 고용노동부장관은 그 훈련을 받는 피보험자등을 대신하여 훈련비용을 해당 신용카드업자에게 지급할 수 있다. <신설 2013.12.24, 2017.6.27, 2021.6.8>
(2) The costs of vocational skills development training under paragraph (1) may be paid to the insured persons, etc. receiving the training or to the institution providing the training: Provided, That where an insured person, etc. receiving training pays the training costs with a credit card under Article 2, subparagraph 3 of the Specialized Credit Finance Business Act (hereinafter referred to as a "credit card") as determined by the Minister of Employment and Labor, and the credit card company that issued the card pays the training costs to the institution providing the training, the Minister of Employment and Labor may pay the training costs to that credit card company on behalf of the insured person, etc.
③ 제1항에 따라 훈련비용을 지원받을 수 있는 훈련과정의 범위와 지원절차 등에 관하여 필요한 사항은 고용노동부령으로 정한다. <개정 2008.4.30, 2010.7.12>
(3) Matters necessary for the scope of training courses whose costs may be subsidized under paragraph (1), the procedures for support, etc. shall be prescribed by Ordinance of the Ministry of Employment and Labor.
