Enforcement Decree of the Official Information Disclosure Act, Article 17 (Bearing of Costs)

① 법 제17조제1항에 따른 정보의 공개 및 우송 등에 드는 비용은 수수료와 우편요금(공개되는 정보의 사본ㆍ출력물ㆍ복제물 또는 인화물을 우편으로 보내는 경우로 한정한다)으로 구분하며, 수수료 금액은 행정안전부령으로 정한다. 다만, 지방자치단체의 경우 수수료의 금액은 조례로 정한다. <개정 2014.11.19, 2017.7.26>

② 법 제15조제1항 및 제2항에 따라 정보통신망을 통하여 정보를 전자적 형태로 공개할 때에는 공공기관(지방자치단체 및 그 소속 기관은 제외한다)의 장은 업무부담을 고려하여 제1항 본문에 따라 정한 수수료 금액의 범위에서 수수료 금액을 달리 정할 수 있다.

③ 다음 각 호의 어느 하나에 해당하는 경우에는 법 제17조제2항에 따라 수수료를 감면할 수 있다.

2. 교수ㆍ교사 또는 학생이 교육자료나 연구목적으로 필요한 정보를 소속 기관의 장의 확인을 받아 청구한 경우

3. 그 밖에 공공기관의 장이 공공복리의 유지ㆍ증진을 위하여 감면이 필요하다고 인정한 경우

④ 법 제17조제2항에 따른 비용감면을 신청할 때에는 감면사유에 관한 소명자료를 첨부하여야 한다.

⑤ 공공기관의 장은 제3항에 따른 비용의 감면비율을 정하고, 정보통신망 등을 통하여 공개하여야 한다.

⑥ 제1항에 따른 수수료는 다음 각 호의 어느 하나에 해당하는 방법으로 낸다. 다만, 부득이한 경우에는 현금으로 낼 수 있다.
