공직선거법 제218조의17(재외투표소의 설치ㆍ운영)

① 재외선거관리위원회는 선거일 전 14일부터 선거일 전 9일까지의 기간 중 6일 이내의 기간(이하 이 장에서 "재외투표기간"이라 한다)을 정하여 공관에 재외투표소를 설치ㆍ운영하여야 한다. 이 경우 공관의 협소 등의 사유로 부득이 공관에 재외투표소를 설치할 수 없는 경우에는 공관의 대체시설에 재외투표소를 설치할 수 있다. <개정 2015.12.24>

② 재외선거관리위원회는 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 사유가 있는 경우에는 재외투표기간 중 기간을 정하여 제1항에 따른 공관 또는 공관의 대체시설 외의 시설ㆍ병영 등에 추가로 재외투표소를 설치ㆍ운영할 수 있다. 다만, 제1호에 따른 사유로 추가하여 설치하는 재외투표소의 경우에는 재외국민수가 3만명을 넘으면 이후 매 3만명까지마다 1개소씩 추가로 설치ㆍ운영하되, 추가되는 재외투표소의 총 수는 3개소를 초과할 수 없다. <개정 2016.1.15, 2022.1.21>

③ 재외선거관리위원회는 선거일 전 20일까지 재외투표소의 명칭ㆍ소재지와 운영기간 등을 인터넷 홈페이지 등에 공고하여야 한다. <개정 2015.12.24>

④ 재외선거관리위원회는 공정하고 중립적인 사람 중에서 재외투표소에 투표사무원을 두어야 한다. <개정 2018.4.6>

⑤ 재외선거관리위원회는 정당추천위원이 아닌 1명의 위원을 책임위원으로 지정하여 재외투표소의 투표관리를 행하게 한다. 다만, 책임위원으로 지정되지 아니한 위원도 본인의 의사에 따라 투표관리에 참여할 수 있으며, 재외투표소의 책임위원에게 투표관리에 관하여 의견을 개진할 수 있다. <개정 2012.1.17>

⑥재외선거관리위원회는 제5항에도 불구하고 제2항에 따라 설치하는 재외투표소에는 재외선거관리위원회가 지정하는 재외투표소관리자로 하여금 투표관리를 행하게 할 수 있다. <신설 2015.12.24>

⑦ 재외투표소는 재외투표기간 중 공휴일에도 불구하고 매일 오전 8시에 열고 오후 5시에 닫는다. 다만, 다음 각 호의 어느 하나에 해당하는 경우 재외선거관리위원회는 예상 투표자 수 등을 고려하여 투표시간을 조정할 수 있되, 중앙선거관리위원회와 협의하여야 한다. <개정 2011.9.30, 2015.12.24, 2022.1.21>

⑧ 제2항에 따른 재외투표소의 설치ㆍ운영, 국군부대에 재외투표소를 설치ㆍ운영할 재외선거관리위원회 지정 및 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <개정 2016.1.15>

⑨ 제163조ㆍ제166조ㆍ제166조의2 및 제167조(제2항 단서는 제외한다)는 재외투표소에 준용한다. 이 경우 "읍ㆍ면ㆍ동선거관리위원회 및 그 상급선거관리위원회"는 "중앙선거관리위원회 및 재외선거관리위원회"로, "투표소"는 "재외투표소"로, "투표관리관"은 "재외투표소의 책임위원 또는 재외투표소관리자"로, "선거일에"는 "재외투표소 안에서"로 본다. <개정 2010.1.25, 2011.7.28, 2015.12.24>
