공직선거법 제218조의33(국외선거범에 대한 인터넷 화상조사)

① 검사 또는 사법경찰관은 「형사소송법」 제200조, 제221조, 제245조의13에 따라 재외공관에 출석한 이 법의 위반행위와 관련된 피의자 또는 피의자 아닌 자를 상대로 인터넷 화상장치를 이용하여 의견 또는 진술을 들을 수 있다. <개정 2026.9.29>

② 제1항에 따라 의견 또는 진술을 들을 경우 검사 또는 사법경찰관은 법무부 및 외교부를 경유하여 해당 재외공관의 장에게 조사할 사건에 관하여 통보하여야 하고, 의견 또는 진술을 들을 때에는 영사가 참여하여야 한다. <개정 2013.3.23, 2026.9.29>

③ 사법경찰관은 제1항에 따라 진술을 들을 경우 그 진술 내용을 기재한 조서를 작성할 수 있고, 그 과정을 영상 녹화하여야 한다. 다만, 피의자가 아닌 자의 경우에는 동의를 받아야 영상녹화할 수 있다. <개정 2026.9.29>

④ 사법경찰관은 작성한 조서를 재외공관에 전송하고, 영사는 이를 출력하여 진술자에게 열람케 하여야 한다. <개정 2026.9.29>

⑤ 제1항에 따른 사법경찰관의 진술 청취의 절차 및 방식에 관하여는 「형사소송법」 제241조, 제242조, 제243조의2부터 제245조까지를 준용하고, 검사의 의견 청취의 절차 및 방식에 관하여는 같은 법 제245조의13을 준용한다. <개정 2026.9.29>
