국민기초생활 보장법 시행령 제5조의4(재산의 소득환산액)

1. 제5조의3제1항제1호의 재산가액 및 같은 항 제3호의 자동차 중 화물자동차 등 보건복지부장관이 정하여 고시하는 자동차의 가액(이하 이 항에서 "일반재산등가액"이라 한다)에서 다음 각 목의 금액(이하 이 항에서 "기본재산액등"이라 한다)을 뺀 금액에 제2항에 따른 소득환산율(이하 이 항에서 "소득환산율"이라 한다)을 곱한 금액. 이 경우 일반재산등가액에서 기본재산액등을 뺀 금액이 0보다 적은 경우에는 일반재산등가액을 0으로 하고, 0보다 적은 차액은 제5조의3제1항제2호의 재산가액에서 뺀다.

2. 제5조의3제1항제2호의 재산가액에서 제21조의2제3항 각 호의 용도로 저축한 금액으로서 금융회사등과의 계약에 따라 해당 용도로만 사용될 수 있도록 개설된 계좌에 입금된 금액(계약기간 만료 전에 해당 저축을 해지하는 경우는 제외한다)을 뺀 금액에 소득환산율을 곱한 금액. 다만, 제1호 각 목 외의 부분 후단에 따라 뺀 금액이 0보다 적은 경우에는 금융재산가액을 0으로 한다.
