Enforcement Decree of the Framework Act on National Taxes, Article 63-11 (Methods and Procedures for Temporary Custody of Books, Etc.)
① 세무공무원은 법 제81조의10제2항에 따라 법 제2조제21호에 따른 장부등(이하 "장부등"이라 한다)을 일시 보관하려는 경우 장부등의 일시 보관 전에 납세자, 소지자 또는 보관자 등 정당한 권한이 있는 자(이하 이 조에서 "납세자등"이라 한다)에게 다음 각 호의 사항을 고지하여야 한다. <개정 2025.6.2>
(1) When a tax official intends to temporarily keep books, etc. under Article 2, subparagraph 21 of the Act (hereinafter referred to as "books, etc.") under Article 81-10 (2) of the Act, the tax official shall, before the temporary custody, inform the taxpayer, holder, custodian, or other person with legitimate authority (hereinafter referred to as the "taxpayer, etc." in this Article) of the following matters:
1. 법 제81조의6제3항 각 호의 사유 중 장부등을 일시 보관하는 사유
1. The ground, among the grounds under the subparagraphs of Article 81-6 (3) of the Act, for temporarily keeping the books, etc.;
2. 납세자등이 동의하지 아니하는 경우에는 장부등을 일시 보관할 수 없다는 내용
2. That the books, etc. cannot be kept temporarily if the taxpayer, etc. does not consent;
3. 납세자등이 임의로 제출한 장부등에 대해서만 일시 보관할 수 있다는 내용

4. 납세자등이 요청하는 경우 일시 보관 중인 장부등을 반환받을 수 있다는 내용

② 납세자등은 조사목적이나 조사범위와 관련이 없는 등의 사유로 일시 보관에 동의하지 아니하는 장부등에 대해서는 세무공무원에게 일시 보관할 장부등에서 제외할 것을 요청할 수 있다. 이 경우 세무공무원은 정당한 사유 없이 해당 장부등을 일시 보관할 수 없다.
(2) The taxpayer, etc. may ask the tax official to exclude from the books, etc. to be kept temporarily those books, etc. whose temporary custody the taxpayer, etc. does not consent to, for reasons such as their being unrelated to the purpose or scope of the investigation. In such cases, the tax official may not keep those books, etc. temporarily without a justifiable reason.
③ 법 제81조의10제4항 및 제5항에 따라 장부등을 반환한 경우를 제외하고 세무공무원은 해당 세무조사를 종결할 때까지 일시 보관한 장부등을 모두 반환하여야 한다.
(3) Except where books, etc. have been returned under Article 81-10 (4) and (5) of the Act, the tax official shall return all books, etc. kept temporarily by the time the tax investigation is concluded.
